All terms and conditions of the Bulk Service
Municipal Agreement between Girard Township, Lake City Municipal Sewer
Authority ("LCMSA"), Lake City Borough and Murphys (the "agreement")
are hereby incorporated by reference into this article.
The agreement shall continue in effect until
terminated upon terms and conditions as set forth in the agreement.
The purpose and objective of the agreement is
for LCMSA to provide bulk wastewater treatment services to Girard
Township, which will permit Murphys to receive wastewater sewer treatment
and wastewater sewer services.
Girard Township has, pursuant to the agreement,
granted to Lake City Borough the power to act as sole and exclusive
billing and collection agent for all sewer rentals owed by Murphys
to Girard Township pursuant to terms as set forth in the agreement.
Girard Township hereby requires Murphys, their
successors or assigns, to pay such sewer rates and charges as are
necessary to reimburse Girard Township for the cost in invoices extended
by the LCMSA and/or Lake City Borough to Girard Township and to comply
with all rules, regulations, ordinances and laws of Girard Township,
Lake City Municipal Authority and Lake City Borough, including but
not limited to the Lake City Borough Code, regarding sewer use and
specifically discharge standards and local limits.
The agreement is financed by the obligations
of Murphys pursuant to the terms of the agreement.
The agreement shall be implemented by Girard
Township, Murphys, the LCMSA and Lake City Borough.
The force main sewer line and rights-of-way
shall be acquired, managed, maintained, repaired and disposed of pursuant
to the terms of the agreement.
