Any sale of merchandise sold from the premises or property in a residential zone, whether it is indoors or outside, shall be considered a garage sale, tag sale or yard sale.
The following regulations shall apply to garage sales, tag sales and yard sales:
A. 
A three-day nonrenewable permit (permit of use) will be required for conducting a garage sale, tag sale or yard sale. A permit must be reapplied for each time a garage sale, tag sale or yard sale is held. Such permit shall only be valid for a maximum of three consecutive days.

B. 
Merchandise bought for the express purpose of resale is prohibited.
C. 
There shall be a limit of two garage sale, tag sale or yard sale permits per year.
D. 
Sales shall be between the hours of 8:00 a.m. and 5:00 p.m. only.
E. 
The permit is automatically revoked should the Village of Fishkill police, senior officer in charge or a Village official state in writing that the garage sale, tag sale or yard sale is creating an unsafe traffic condition.
F. 
In the event the application for a permit is made by a tenant of the premises (rather than the owner), such application shall require the written permission of the owner.

Three temporary signs may be posted on the date(s) of sale, subject to the following conditions:
A. 
Each sign shall not exceed six square feet.
B. 
Each sign be removed at the end of the sale.

The fee for each permit shall be $10.

Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof, be punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or both.
