A. 
Shopping centers and private apartment complexes.
(1) 
In accordance with §§ 1100 and 1640-a of the Vehicle and Traffic Law of the State of New York, traffic and parking regulations are hereby established for the parking areas listed below, pursuant to the written request of the owner of a parking area in a shopping center or private apartment complex located in the Village of Fishkill:
(a) 
Main Street Plaza (Grand Union) formerly known as A & B Shopping Center, Route 52 and Carey Avenue, Village of Fishkill, New York.
(b) 
Ames Plaza (Fishkill Center Associates) formerly known as King's Shopping Center, Route 52 and Blodgett Road, Village of Fishkill, New York.
(c) 
Cecilwood Apartments, Route 52, Village of Fishkill, New York.
(2) 
The shopping centers and private apartment complexes designated in Subsection A(1) above shall be subject to the following regulations and restrictions:
(a) 
Parking, standing or stopping of vehicles within areas marked "no parking" or "fire zone" is prohibited except for vehicles delivering merchandise.
(b) 
No vehicle shall stop, stand or park in front of any doorway in said shopping center, except for vehicles delivering merchandise.
(c) 
Those areas set forth in Subsection A(2)(a) and (b) of this section shall be known as "fire lanes" in said parking areas.
(d) 
No vehicle shall stop, stand or park in such a manner that said vehicle obstructs the flow of traffic into or from the shopping area or apartment complex onto a public street.
(e) 
Any vehicle parked or abandoned in said fire lanes during snowstorms, floods, fires or other public emergencies shall be removed, upon the order of the Chairman of Highways and Streets Committee and/or the Police and Fire Chief, to a suitable storage facility and may not be recovered except upon payment to the Village Clerk for all expenses incurred in the removal and storage of said vehicle by the owner or operator of the same.
B. 
Public parking lots.
(1) 
No vehicle shall be parked for more than two hours between 7:00 a.m. and 9:00 p.m. in the municipal parking lots in the Village of Fishkill, New York. Parking shall be permitted in the designated parking spaces only.
(2) 
No vehicle shall be parked between 2:00 a.m. and 7:00 a.m. in any municipal parking lot located in the Village of Fishkill, New York, except that firemen on duty shall be allowed to use said lots for overnight parking. This is with the exception of the Givens Lane municipal parking lot, where overnight parking of vehicles shall be allowed for resident parking permit holders, as hereinafter provided.

C. 
Overnight parking permit rules for Givens Lane municipal parking lot.

(1) 
Resident parking permits for Givens Lane lot. Any property owner within the VC-BD District of the Village of Fishkill may obtain a resident parking permit for overnight parking in the Givens Lane municipal parking lot, subject to regulations and fees, as hereafter established. Upon filing application and payment to the Village Clerk of an amount set by resolution of the Board of Trustees, a permit shall be issued, which shall be valid from October 1 to September 30 of each year. Said application shall certify that the applicant is a Village property owner within the VC-BD District. It shall further have attached proof that the permitted vehicle(s) is a passenger automobile registered with the New York State Department of Motor Vehicles having a Village of Fishkill address within the VC-BD District. In the alternative, proof that the vehicle to be permitted is on a long-term lease to a Village resident within the VC-BD District shall be submitted with the permit application.
(2) 
VC-BD District compliance authorized; vehicle storage prohibited. Current Village law prohibits parking in all municipal parking lots from 2:00 a.m. to 7:00 a.m. The permit granted hereunder, shall allow for parking in the Givens Lane municipal parking lot at all times, including the prohibited time of 2:00 a.m. through 7:00 a.m. However, no extended parking (i.e., for more than 24 consecutive hours) or vehicle storage shall be allowed under this permit system. A parking permit granted under this provision of the Village law may be used to satisfy the residential parking requirement within the VC-BD District, as set forth in other provisions of the Village Code.
(3) 
Permit decals. A parking permit decal shall be issued to each permit holder and must be affixed to the interior of the rear window on the driver's side of the vehicle for which the permit has been issued. All permitted vehicles are required to park facing into the parking space, so that the permit decal is easily visible to enforcement authorities.
(4) 
Partial year permit. Any property owner who applies for a parking permit six months or more after October 1 will be charged a prorated fee for a partial year, as set forth by resolution of the Board of Trustees.
(5) 
Prohibited acts. It is a violation of this section:
(a) 
To park a vehicle in the permit parking lot without an overnight parking permit decal issued under this section, during the period from 2:00 a.m. to 7:00 a.m.
(b) 
For any person issued a permit decal to transfer the same or cause the same to be transferred to any other person or vehicle in violation of this article. This violation shall apply to both the person so transferring and the person so receiving or benefitting from the transfer.
(c) 
For the purposes of this section, the owner of any vehicle parked in violation hereof shall be presumed to have parked the vehicle unless the person actually operating the vehicle is identified by the police officer or other person issuing the parking ticket. In the event that the person operating the vehicle is so identified, then the parking ticket shall be issued to the operator.
