Private swimming pools may be erected or installed
only as an accessory to a dwelling, private club, community building
or commercial structure for the use of the owner or occupant, their
families, guests and/or invitees.

No aboveground swimming pool or in-ground swimming
pool shall be erected closer than 10 feet from the rear or side property
lines and no closer than 10 feet from the principal dwelling. The
swimming pool shall in all other respects comply with the State Building
Code (L.L. No. 5-1965)[1] and the Town of Hamburg Zoning Code (L.L. No. 4-1966).[2]
