In order to carry out the policies embedded in the Comprehensive Master Plan for the Town of Hamptonburgh, through administration and enforcement of Chapter
150, Zoning, and the policies embodied in these regulations, the Town Planning Board may require the preparation of a Land Development Plan.
A Land Development Plan shall consist of graphic
and textural materials in sufficient detail to describe the location
and characteristics of any proposed development, in accordance with
the conceptual plan checklist.
Following receipt of the Land Development Plan, when required by the Planning Board, the Planning Board shall determine whether the proposed development is consistent with the Comprehensive Development Plan, Chapter
150, Zoning, and this chapter. Where the Board deems necessary, recommendations may be made in the form of a written critique or suggested alternate plan. Upon receipt and review of the Land Development Plan, the applicant shall prepare revisions to the conceptual plan necessary to conform to the requirements of this chapter. Where conflicts occur, the applicant shall fully justify deviations from the requirements set forth in the initial review. After review of the Land Development Plan has been completed by the Planning Board, the applicant shall submit its preliminary plat for review as provided herein.
The Planning Board's review of the Land Development
Plan does not grant the applicant any vested rights or expectations
of rights to develop the undeveloped portion of the subdivision.
