The office of Ombudsman/Director of Human Resources is hereby established
in and for the City of Jamestown. The Ombudsman/Director of Human Resources
shall be appointed by the Mayor, subject to the approval of a majority of
all the members of the City Council, for a term to run concurrent with the
term of the Mayor, at such salary as the Council shall provide.
A.
The Ombudsman/Director of Human Resources shall have
the power and duty to receive complaints, suggestions and requests for information
from any person concerning administrative matters of government and to assist
citizens with problems in dealing with City government or any department,
board or agency thereof. Notwithstanding the provisions hereof, if any suggestion
or complaint relates to the Police Department or any member thereof, the Ombudsman/Director
of Human Resources shall immediately forward the suggestion or complaint to
the Chief of Police, who shall make such investigations as he shall deem necessary.
The Ombudsman/Director of Human Resources may, however, in his/her sole discretion,
decline to investigate any complaint he/she may receive. The Ombudsman/Director
of Human Resources is also authorized to perform such other and further duties
as may be assigned to him/her by the Mayor. The Ombudsman/Director of Human
Resources shall have the power to appoint, employ and supervise such other
personnel in his/her office, within the limits of any authorization and appropriation
made by the City Council, as may be necessary to carry out its functions.
B.
In addition to the powers and duties described above,
the Ombudsman/Director of Human Resources shall also have the following duties
and responsibilities:
(1)
The Ombudsman/Director of Human Resources shall serve
as the City's chief negotiator and spokesman for all matters pertaining to
the City's collective bargaining agreements with its recognized public employee
labor organizations, with the exception of public employee labor organizations
under the jurisdiction of the Board of Public Utilities.
(2)
The Ombudsman/Director of Human Resources shall be responsible
for the day-to-day administration of all collective bargaining agreements
between the City and its recognized public employee labor organizations, with
the exception of public employee labor organizations under the jurisdiction
of the Board of Public Utilities.
(3)
The Ombudsman/Director of Human Resources shall be responsible
for the administration of the City's self-insured medical insurance program
and all matters pertaining thereto.
(4)
The Ombudsman/Director of Human Resources shall have
primary responsibility for the administration of all personnel matters, including
but not limited to the development and enforcement of personnel policies and
procedures, with the exception of personnel matters under the jurisdiction
of the Board of Public Utilities.
(5)
The Ombudsman/Director of Human Resources shall be responsible
for the administration of the City's workers' compensation plan, including
overseeing all employee incident reports, as well as all New York State compensation
reports.
(6)
The Ombudsman/Director of Human Resources shall be responsible
for administration of the City's hiring process in accordance with applicable
Civil Service Law and the rules and regulations pertaining thereto.
(7)
The Ombudsman/Director of Human Resources shall serve
as the City's Affirmative Action Officer and shall oversee the activities
of the City's Human Rights Coordinator and Senior Citizen Advocate, who shall
report directly to the Ombudsman/Director of Human Resources.
(8)
The Ombudsman/Director of Human Resources shall have
primary responsibility for all other matters involving the personnel administration
of the City not specifically referred to herein.
