A. 
Residential, nonresidential, commercial and industrial buildings and accessory structures, whether occupied or vacant, shall be maintained in conformity with the provisions of this chapter.
B. 
In order to prevent the excessive growth of weeds and grass, it is hereby declared that all lots, whether residential, nonresidential, commercial or industrial, shall be maintained in conformity with the standards set out in this chapter so as to assure that the subdivision and community at large will not be adversely affected.

A. 
It is a mandatory requirement that all owners of residences which contain at least one rental unit complete and file a landlord registration form with the Jamestown City Clerk/Treasurer. The form is to be filed within 30 days upon receipt thereof or immediately upon request of the City Clerk/Treasurer.

B. 
If the information on a previously filed landlord registration form changes for any reason, it is the current owner's responsibility to immediately correct the information on the applicable form on file.
C. 
Landlord registration forms are available at and are to be filed with the Jamestown City Clerk/Treasurer's office, 200 E. 3rd St., Jamestown, NY 14701.

D. 
The Director of Development and his/her agents shall be responsible for enforcement of this Code.
E. 
Penalties for offenses of this section shall be punishable by provisions stated in Chapter 215, § 215-68 of the Jamestown City Code.

A. 
Surface and subsurface water shall be appropriately drained to protect buildings and structures and to prevent development of stagnant ponds. Gutters, culverts, catch basins, drain inlets, stormwater sewers, approved combined storm and sanitary sewers or other satisfactory drainage systems shall be utilized where deemed necessary.
B. 
Fences and other minor constructions shall be maintained in safe and substantial condition.
C. 
Steps, walks, driveways, parking spaces and similar paved areas shall be maintained so as to afford safe passage under normal use and weather conditions.
D. 
Yards and courts shall be kept clean.
E. 
Overgrown weeds, grass, brush and other vegetation.

(1) 
It shall be the duty of every owner, occupant or person having charge of lands within the City of Jamestown to cut down or cause to be cut down all overgrown weeds, grass, brush and other vegetation in excess of six inches and to remove or cause to be removed all garbage, weeds, grass or other rank, poisonous or noxious vegetation and tree limbs or other debris on said land as often as necessary to maintain such land in a sanitary and orderly condition and to comply with the provisions of § 215-42.
(2) 
It shall be unlawful for any person having control or ownership of any type of tenancy in any lot in a residential, nonresidential, commercial or industrial zone in the City of Jamestown, County of Chautauqua and State of New York, to permit or maintain on such land, or portion thereof, any growth of weeds, grass or other rank vegetation to a greater height than six inches on the average or any accumulation of dead weeds, grass or brush.
(3) 
Failure to comply with this section shall constitute a violation of this section and shall be punishable in accordance with §§ 215-68 and 215-72.
F. 
Exterior property areas shall be free from conditions which may create a health, accident or fire hazard. Trees growing within 24 inches of the foundation of a home must be removed.

G. 
Exterior property areas shall be free from holes and excavations, sharp protrusions and other objects or conditions which might cause personal injury. Walks, steps and driveways that contain holes or tripping hazards shall be filled, repaired or replaced to conform to their intended use; wells, cesspools or cisterns shall be securely closed; and trees or limbs of trees that constitute a hazard shall be removed.
H. 
No motor vehicle as such is defined by the Vehicle and Traffic Law of the State of New York nor trailer, camper or boat, whether registered or unregistered, shall be parked or stored in the front yard of any residential building whether such building is occupied or vacant.

I. 
Repair of motor vehicles in residential areas. It shall be unlawful for any person to perform automotive repair on any motor vehicle in an area zoned for detached single-family or multifamily dwelling units in the City, except under the following condition: Any person may perform automobile repair work on one currently licensed motor vehicle titled or registered in his/her name or in the name of a member of his/her immediate family, provided that such work shall be done within a garage of suitable dimensions for said repairs on the premises of his/her residence; and provided, further, that such work shall not be performed in violation of any other City ordinance. A person may only perform repair work on one motor vehicle at a time.

J. 
Repair of combustion engines in residential areas. It shall be unlawful for any person to perform repairs on any combustion engine in an area zoned for detached single-family or multifamily dwelling units in the City, except under the following condition: Any person may perform automobile repair work on a currently licensed motor vehicle titled or registered in his/her name or in the name of a member of his/her immediate family, provided that such work shall be done within a garage of suitable dimensions for said repairs on the premises of his/her residence; and provided, further, that such work shall not be performed in violation of any other City ordinance.

A. 
Grounds, building and structures shall be maintained free of insects, vermin and rodent harborage and infestation. Methods used for exterminating insects, vermin and rodents shall meet the generally accepted Health Department standards and shall be in accordance with the manufacturer's specifications.
B. 
The exterior of every structure shall be so maintained as to be vermin and rodent free. All exterior windows, doors and other openings shall be screened or protected with approved materials. Defects, cracks or holes shall be tightly sealed to prevent the entrance of vermin and rodents.
A. 
The exterior of the property area shall be kept free from organic and inorganic material that might become a health, accident or fire hazard, including but not limited to:

(1) 
Accumulations of clothing and any other items not designed for outdoor storage;
(2) 
All household garbage, dead animals, animal and human waste and waste material;
(3) 
Accumulations of dead organic matter and yard debris, with the exception of small accumulations of such material in a maintained compost area on the property and only if such material does not result in a nuisance, such as creating rat harborage or insect infestation; and
(4) 
Accumulations of litter, glass, scrap materials (such as wood, metal, paper and plastics), junk, combustible materials, stagnant water or trash.
B. 
Approved sanitary facilities and methods shall be used for the collection, storage, handling and disposal of garbage and refuse. It shall be prohibited to store or accumulate garbage or refuse in halls or stairways. Receptacles for storage of garbage, refuse, and recyclable materials shall not be located in the area which extends from the primary residential structure to the exterior property line. Every dwelling and every dwelling unit shall be provided with as many such receptacles as necessary to contain all garbage and refuse, and all such receptacles shall be maintained in good repair. Receptacles for garbage shall be made of durable material, watertight and provided with tight-fitting covers. Garbage and refuse shall not be put out for collection before 6:00 p.m. on the day prior to the regularly scheduled garbage, refuse and recycling pickup of the Board of Public Utilities or remain at the front of the property for more than 12 hours after pickup.

C. 
In multiple dwellings, it shall be prohibited to store or accumulate garbage or refuse in public halls and stairways.
Domestic animals and pets shall not be kept on any premises in such manner as to create unsanitary conditions or to constitute a nuisance.

No fence, wall, shrub planting, tree foliage or other permanent structure within five feet of the side of any driveway, which obstructs vision or is three feet or higher above sidewalk level, shall be placed or maintained within eight feet of the point at which said driveway intersects a sidewalk.

The use, keeping or storage of any upholstered furniture, including mattresses, manufactured primarily for indoor use, shall be prohibited in any yard and on any unenclosed porch.
