Prior to the filing of an application for approval of a subdivision layout, the subdivider shall prepare a sketch of the proposed subdivision, indicating the layout of proposed streets, subdivision lots, streams and existing streets, which shall be submitted to the City Planning Commission with a request for informal consideration and advice. At the informal hearing, the subdivider shall be prepared to discuss with the Commission the following items:
A. 
The name of the proposed subdivision.
B. 
The name of the owner, owners or corporate entity, the address and the telephone number.
C. 
The proposed zoning use or uses.
D. 
The location of the premises with respect to existing highways or nearby streets.
E. 
The number of acres in the entire proposed subdivision.
F. 
The topography of the premises.
G. 
The proposed location of any free area or recreational site.
H. 
The anticipated method of marketing of the lots, whether the subdivider intends to build and sell houses or sell lots singly or in multiples to prospective builders.
I. 
A general statement as to the type of home to be erected and the value of the same.
J. 
If the proposed layout covers only a portion of the entire parcel owned or controlled by the subdivider, a plan for the street layout of the entire parcel.
K. 
The name and the location of all adjoining parcels of property, including those on the opposite side of existing streets or highways.
L. 
The source of water supply.
M. 
Provisions for stormwater and sanitary disposal.
N. 
Plans for the establishment of special improvement districts.
O. 
Nearby land uses and structures.
P. 
Contemplated and existing deed restrictions.
Q. 
All other matters pertinent to the proposed subdivision.
A. 
Contents. The subdivider shall thereafter and within six months of the informal hearing submit to the Commission a preliminary layout, together with a topographical map, if the same has been required by the Commission. Such preliminary layout shall be to scale of 200 or fewer feet to one inch and shall show all proposed streets, subdivision lots, recreation areas, other types of proposed uses, streams, drainage ditches and the total acreage owned or controlled by the subdivider, together with a key map locating the subdivision with regard to nearby streets and farm lots, and shall embody the features agreed upon at the informal hearing. Such preliminary layout shall be prepared by a licensed land surveyor, landscape architect or engineer and shall bear his seal or signature. In addition thereto, the statement of the Director of Public Works shall be submitted, setting forth his opinion of the feasibility of supplying sanitary sewers, storm sewers and waterlines and connecting the same with public disposal or supply facilities, together with his opinion of the feasibility of constructing and maintaining streets and other utilities, public and private.
B. 
Hearing; approval or disapproval. Within 45 days after submission of the preliminary layout and all other required maps or other documents, the Commission shall hold a hearing concerning the proposed subdivision. Based upon the maps and documents submitted and any other pertinent matters discussed at such hearing, the Commission shall approve, conditionally approve or reject the preliminary layout. Written notice of the Commission's decision shall be sent to the subdivider within 30 days after such hearing. If conditional approval is given, the conditions shall be set forth in the written notice; if the proposed subdivision is rejected, the reasons for such rejection shall be set forth in the written notice. The hearing held pursuant hereto need not be advertised, and no notice of the same need be given to any person except the subdivider. The Commission shall have the authority to give notice of such hearing to any other person or persons as it shall deem to be interested therein or to have special knowledge of the matters involved.
A. 
Contents. The subdivider shall submit to the Commission, in triplicate, a final subdivision map embodying all the matters theretofore agreed upon within six months after receipt of the written notice provided for in § 260-5B. Such map shall be prepared by a licensed land surveyor, landscape architect or engineer and shall bear his seal or signature. Such map shall have a scale of not more than 200 feet to one inch, preferably 100 or fewer feet to one inch. Such map shall delineate all proposed water, storm sewer and sanitary sewer lines. All streets shall be named, and the names must be approved by the City Planning Commission.
B. 
Hearing; approval or disapproval. Within 45 days after submission of the final subdivision map, the Commission shall hold a public hearing concerning the proposed subdivision, which shall be advertised at least once in an official newspaper of general circulation in the City at least five days before such hearing. The Commission may thereupon approve, modify and approve or disapprove such plat. Written notice of the Commission's decision shall be sent to the subdivider within 45 days after submission of the final subdivision map, which notice shall contain the reasons for modification or disapproval if either such action is taken. If modifications are required, such modifications shall be completed within three months after such notice is sent to the subdivider, or the application shall be considered to be disapproved. If modifications are timely made and the subdivision map thereupon presented to the Commission at a regular or special meeting and if the Commission then determines that the subdivision map shall be approved, it shall so indicate within five days after such meeting.
C. 
Required notations. The following notations must appear on all subdivision maps before final approval by the Commission.
(1) 
"No building permit for construction on any lot in this subdivision will be issued if the width of the lot area is less than that indicated on this subdivision map unless a change in lot size is approved by the City Planning Commission."
(2) 
"Approval of this subdivision map by the City Planning Commission shall not be deemed to be acceptance of offer of cession or dedication of public streets. No building permit will be issued until such acceptance is made by the City of Jamestown."
A. 
Pursuant to § 32 of the General City Law, any approval by the Commission of a subdivision map shall expire unless within 90 days after such approval such subdivision map shall have been duly filed or recorded by the owner in the office of the County Clerk.
B. 
The time of submission of any map, plat or other document to the Commission shall be deemed to be at the time of the regular meeting of the Commission at which such map, plat or document is delivered to the Commission or at the time of the next regular meeting of the Commission following delivery of the map, plat or document to any member of the Commission or to the City Clerk/Treasurer. In the event that no regular meeting is held within 30 days of such delivery, such submission shall be deemed to have been made 30 days after such delivery.

C. 
The Chairman or Acting Chairman of the Commission at any hearing held pursuant hereto may adjourn such hearing for a period of time not to exceed one week unless a longer period of time shall be agreed upon by the subdivider and the Commission. In the event of an adjournment, any pertinent time period shall be tolled for the period between the date of such hearing and the adjourned date.
