By the adoption of this article, the Town Board of the Town of Kent discloses its intent to regulate the operation within the Town of the refuse disposal area to be determined by the Board and to prohibit the disposing of refuse in the Town at any other site, unless otherwise directed by the Board. The disposing of refuse, garbage and rubbish in an open area constitutes a menace to the public health, safety and welfare and can have an adverse effect upon the growth and development of the Town. Therefore, pursuant to the authority contained in the Town Law § 130, Subdivision 6, and pursuant to the police power contained in the Town Law, the Town Board of the Town of Kent does hereby ordain the following.
A. 
It shall be unlawful, after the date of the enactment of this article, to dump refuse, garbage and other debris in any area of the Town of Kent other than the refuse disposal area off Ressiquie Street, during the hours of its posted operation.
B. 
No commercial operator who is directly engaged in the regular cartage of garbage, refuse and debris shall enter the area of the refuse disposal site or the access road leading thereto unless he shall have obtained a permit from the Town Clerk, which permit shall specify the hours and days of the permitted use of the area.
C. 
The Town Clerk shall receive a fee, to be determined resolution of the Town Board, for issuing a permit, which shall be valid for a period of one year for commercial carters. Commercial carters, in addition to this yearly permit, shall pay, by the yard, for compacted and uncompacted garbage, fees that will be determined by resolution of the Town Board. Residents shall pay a yearly fee for pickup trucks and regular vehicles, which will be determined by resolution of the Town Board.

D. 
Anyone collecting or hauling garbage or refuse through the Town of Kent, or using the disposal field of the Town of Kent for the disposal of garbage or refuse, shall henceforth cover all such vehicles with a covering to prevent such garbage or refuse from being strewn on the roads.

E. 
No garbage, refuse, rubbish or other material that does not have its origin within the Town of Kent shall be deposited or disposed of in the Town refuse disposal area.

F. 
Any permittee under the provisions of Subsections B and C of this section shall comply with all additional regulations governing the collection and/or disposal of garbage, refuse, rubbish and other waste materials which may be promulgated by the Town Board.

G. 
No automobile, truck or other motor vehicle or part thereof shall be deposited or disposed of in the Town disposal area.

H. 
Each permit shall commence January 1 of each year.

I. 
Each permit for a commercial operator shall be conspicuously displayed on the motor vehicle of the carter.

Any person who consents to or permits any act or acts in violation of any of the provisions of this article shall be deemed to have committed an offense against such article and shall be punishable by a fine not exceeding $500 or by imprisonment for not exceeding 30 days, or both, for each violation, in addition to revocation of the permit to use said refuse disposal area. Each day such violation shall continue or be permitted to exist shall constitute a separate offense.
