Editor's Note: This local law also provided that to the extent that it is inconsistent with Town Law §§ 265-a, 274-a, 276 and 277 or any other provision of Article 16 of the Town Law, the provisions of L.L. No. 8-2008 are expressly intended to and do supersede any inconsistent provisions, pursuant to Municipal Home Rule Law § 10, Subdivisions 1(ii)d(3), and 1(ii)a(14), and § 22.
A. 
Site plan. A site plan approval shall be exempt from the requirements of Local Law No. 8 of 2008 if, on or before November 24, 2008, the Planning Board adopted a resolution granting conditional final or final site plan approval and said approval has not expired. This exemption shall apply to any application for an extension of such approval pursuant to New York State Town Law or the Town of Kent Code after November 24, 2008, and for the period of any extension granted pursuant to such application. This exemption shall not apply to any amendment to such approval after November 24, 2008.
B. 
Special use permit. A special use permit approval shall be exempt from the requirements of Local Law No. 8 of 2008 if, on or before November 24, 2008, the Planning Board or the Zoning Board of Appeals adopted a resolution granting conditional final or final special use permit approval and said approval has not expired. This exemption shall apply to any application for an extension of such approval pursuant to New York State Town Law or the Town of Kent Code after November 24, 2008 and for the period of any extension granted pursuant to such application. This exemption shall not apply to any amendment to such approval after November 24, 2008.
C. 
Conditional use permit. A conditional use permit approval shall be exempt from the requirements of Local Law No. 8 of 2008 if, on or before November 24, 2008, the Planning Board or the Zoning Board of Appeals adopted a resolution granting conditional final or final conditional use permit and said approval has not expired. This exemption shall apply to any application for an extension of such approval pursuant to New York State Town Law or the Town of Kent Code after November 24, 2008, and for the period of any extension granted pursuant to such application. D. 
Subdivision. An application for subdivision approval shall be exempt from the requirements of Local Law No. 8 of 2008 if, on or before November 24, 2008, the Planning Board approved a resolution granting preliminary or conditional preliminary subdivision approval or final conditional or final subdivision approval, and said approval has not expired. This exemption shall apply to any application for an extension of such approval pursuant to New York State Town Law or the Town of Kent Code after November 24, 2008, and for the period of any extension granted pursuant to such application. This exemption shall not apply to any amendment to such approval after November 24, 2008.
