After engineering review and discussions with personnel of the Upper Uwchlan Police Department, it is determined to be in the public safety and for the benefit of the public welfare of the residents of Upper Uwchlan Township and in the public welfare of the traveling public in general to designate certain intersections as being regulated by stop signs. The following is a listing of various intersections within the Township which have been determined pursuant to said studies to be in need of regulation by the stopping of vehicles at said intersections. Unless otherwise set forth below, the first-mentioned street of each intersection shall be the stop street and the second-mentioned street shall be the through street.

Any operator of any motor vehicle violating the provisions of this section and failing to stop in accordance with the provisions of the Pennsylvania Motor Vehicle Code[1] or otherwise violating the provisions of the Pennsylvania Motor Vehicle Code by failing to adhere to the regulations set forth herein and in said code shall be subject to prosecution in accordance with the procedures, fines and penalties as set forth in the Pennsylvania Motor Vehicle Code. The provisions of this section and the Pennsylvania Motor Vehicle Code shall be enforceable by a duly authorized police officer having jurisdiction.

Official stop signs shall be erected (or ratified if previously erected) in such a position as to face traffic approaching the first-named street (the intersection of through street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first-named street or stop street in the direction indicated in each case shall stop the vehicle as required by the Vehicle Code and shall not proceed into or across the second-named or intersecting or through street until he has followed all applicable requirements of that section of the law.

§ 176-2 Yield intersections.

Yield signs shall be posted on the following roads:

From and after effective date hereof, the driver of a vehicle approaching a yield sign shall in obedience to the sign slow down to a speed reasonable for the existing conditions and, if required for safety to stop, shall stop before entering a crosswalk on the near side of the intersection or, if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering. After slowing down or stopping, the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute a hazard during the time the driver is moving across or within the intersection of roadways. If the driver is involved in a collision with a vehicle in the intersection or junction of roadways after driving past a yield sign, the collision shall be deemed prima facie evidence of failure of the driver to yield the right-of-way.

Yield signs shall be erected in accordance with the provisions of the Vehicle Code and in compliance with the regulations of the Pennsylvania Department of Transportation.

Anyone violating any of the provisions of Subsection A of this section shall be subject to proceedings and penalties as set forth in the Vehicle Code of the Commonwealth of Pennsylvania.

From and after the effective date hereof, no person shall drive or operate any vehicle on the above-named roads at a speed greater than the speed set forth in this section.

Speed limit signs setting forth the maximum speed shall be erected in accordance with the provisions of the Vehicle Code and in compliance with the regulations of the Pennsylvania Department of Transportation.

Anyone violating any of the provisions of Subsection A of this section shall be subject to proceedings and penalties as set forth in the Vehicle Code of the Commonwealth of Pennsylvania.

§ 176-4 No-passing zones.

A no-passing zone shall exist on Font Road from Route 100 to the Upper Uwchlan Township border.

Compliance by drivers. Where signs and markings are in place to define a no-passing zone as set forth in Subsection A, no driver shall at any time drive on the left side of the roadway within the no-passing zone or on the left side of any pavement striping designed to mark a no-passing zone throughout its length.

Signs and striping setting the no-passing zones shall be placed in accordance with the provisions of the Vehicle Code and in compliance with the regulations of the Pennsylvania Department of Transportation.

Anyone violating any of the provisions of Subsection A of this section shall be subject to proceedings and penalties as set forth in the Vehicle Code of the Commonwealth of Pennsylvania.

§ 176-5 Traffic control devices.

Little Conestoga Road and Park Road.

(1)

Traffic control devices shall be erected on the following road: the intersection of Little Conestoga Road and Park Road.

(2)

From and after the effective date hereof, duties of drivers shall be as follows when approaching these signals:

(a)

Flashing signals, general rule. Whenever a flashing red or yellow signal is used in a traffic signal or with a traffic sign it shall require obedience by vehicular traffic as follows:

Flashing red. When a red lens is illuminated with rapid intermittent flashes, drivers of vehicles shall stop in the same manner as at a stop sign, and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign as provided in Section 3323 of the Vehicle Code (relating to stop signs and yield signs).[1]

Flashing yellow. When a yellow lens is illuminated with rapid intermittent flashes, drivers of vehicles may proceed through the intersection or past such signals only with caution.

(3)

Traffic control devices shall be erected in accordance with the provisions of the Vehicle Code and in compliance with the regulations of the Pennsylvania Department of Transportation.

(4)

Anyone violating any of the provisions of Subsection A(1) of this section shall be subject to proceedings and penalties as set forth in the Vehicle Code of the Commonwealth of Pennsylvania.

Moore Road.

(1)

Traffic control devices shall be erected on the following road: Moore Road, between Twin Pines and Laura Drive.

(2)

From and after effective date hereof, drivers shall proceed at 20 miles per hour. Drivers shall be required to slow down to a slower speed should any existing condition warrant it.

(3)

Signs shall be erected in accordance with the provisions of the Vehicle Code and in compliance with the regulations of the Pennsylvania Department of Transportation.

(4)

Anyone violating any of the provisions of Subsection B(2) of this section shall be subject to proceedings and penalties as set forth in the Vehicle Code of the Commonwealth of Pennsylvania.

West Township Line Road.

(1)

Traffic control devices shall be erected on West Township Line Road at Turnstone Way and at Peregrine Lane.

(2)

From and after effective date hereof, drivers shall proceed at 20 miles per hour. Drivers shall be required to slow down to a slower speed should any existing condition warrant it.

(3)

Signs shall be erected in accordance with the provisions of the Vehicle Code and in compliance with the regulations of the Pennsylvania Department of Transportation.

(4)

Anyone violating any of the provisions of Subsection C(2) of this section shall be subject to proceedings and penalties as set forth in the Vehicle Code of the Commonwealth of Pennsylvania.

§ 176-6 Parking, stopping and standing restrictions.

There shall be no stopping, standing or parking at all times at the following locations:

(1)

State Road Route 100 from the border with Uwchlan Township to the border with West Vincent Township.

(2)

Lakeview Road East between Milford Road and dead end to the lake.

(3)

Both sides of Park Road from the Pennsylvania Turnpike to the entrance of Marsh Creek State Park.

(4)

Both sides of Moore Road, from Park Road to Dorlans Mill Road.

(5)

The Marsh Creek Dam entrance on Dorlans Mill Road.

(6)

Pondview Drive.

(7)

Ticonderoga Boulevard from Route 100 to Park Road.

(8)

Bennett Court and Buffington Circle.

No motor vehicle shall stop, stand or park on any Township road when a no-stopping, no-parking or any combination of the wording or recognized symbols is posted by sign on the said roadway where such activity is intended to be prohibited.

No person shall stop, stand or park their motor vehicle on any road in Upper Uwchlan Township in the following manner:

(1)

Against the flow of traffic.

(2)

Double parked.

(3)

Blocking a street.

(4)

Leaving or letting stand an abandoned or disabled vehicle.

(5)

Blocking a driveway, crosswalk or sidewalk.

(6)

In locations designated in Subsection A of this section where signs prohibit parking or stopping or standing.

(7)

In a marked or posted fire lane.

(8)

In a handicapped zone.

(9)

Within 15 feet of a fire hydrant.

(10)

Restricting/blocking a means of egress.

(11)

Where signs prohibit stopping, standing or parking.

(12)

Obstructing a Fire Department connection.

(13)

Where prohibited by the Pennsylvania Vehicle Code.

No motor vehicle shall be left standing or parked on any Township roadway when the roadway is snow covered or when any emergency is declared by the Chief of Police, his/her designate, the Township Manager or a member of the Board of Supervisors that has been given written or verbal notice that the vehicle is creating a hazard to traffic movement during snow or other activity. Temporary no-stopping, no-standing, and no-parking zones can be established, and the duration (times) of such zones, by the Upper Uwchlan Township Board of Supervisors, the Township Manager or the Chief of Police. Such zones shall be posted 24 hours prior to the commencement of the established time for the zone. The zones shall be posted to inform motorists.

From and after the effective date hereof, no person shall operate, stop, stand or park any vehicle contrary to provisions of this section as set forth herein.

Any person violating any of the provisions of this section commits a summary offense and shall, upon conviction, be sentenced to pay a fine of $25 within eight days of the time such alleged offense was committed. If the fine is remitted by mail, then a remittance postmarked within the eight-day period shall be considered as meeting the requirements of this subsection. A receipt shall be issued for all money so received, and such money shall be promptly turned over to the Treasurer to be used in the manner provided for the disposition of fines for traffic violations. The members of the Upper Uwchlan Township Police Department are hereby authorized to refrain from instituting a prosecution for the alleged offense involved.

The fact that an automobile, which is illegally parked, is registered in the name of a person shall be considered prima facie proof that such person was under control of the automobile at the time of such parking.

Upper Uwchlan Township may take appropriate actions or proceedings at law or equity for the enforcement of this section.

When the penalty imposed for the violation of this section is not voluntarily paid to Upper Uwchlan Township, the Township shall initiate enforcement proceedings before a Magisterial District Judge in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure.

§ 176-7 Technical specifications for traffic control signalization.

Be it ordained that technical specifications for traffic control signalization as prepared by McMahon Associates, Inc., dated September 15, 1999, are hereby established.

§ 176-8 Speed-timing devices.

The words and phrases used in this section shall have the meanings respectively ascribed to them in the Pennsylvania Vehicle Code (Act 81), Chapter 1, Section 102,[1] Definitions, as supplemented and amended.

The Board of Supervisors hereby declares that it has approved the use of speed-timing devices to aid in the enforcement of Upper Uwchlan Township's speed restrictions.

The types of speed timing devices which can be used shall be either mechanical or electrical timing devices which are approved by the Department, as provided in 75 Pa.C.S.A. § 3368 (the Vehicle Code). For example, and not by way of limitation, the Board of Supervisors specifically authorizes the use of the Model TK 100 Excessive Speed Preventor, manufactured by Systems Innovation, Inc., Box 357, Hallstead, Pennsylvania. The above speed-timing device was approved under the provisions of 75 Pa.C.S.A. § 3368(d) by the Department on December 16, 1978.

The peace officers of Upper Uwchlan Township are authorized and directed to use the approved speed-timing devices to aid in the enforcement of the Township's speed restrictions.

Legible signs giving public notice of the use of speed-timing devices shall be posted at or near the public highways of Upper Uwchlan Township.

§ 176-9 Engine brake retarders/compression release engine brakes.

The use of brake retarders, compression-release engine brakes or similar devices by truck operators upon the following roadways is prohibited, unless the vehicle has the proper sound control or muffler devices:

(1)

Graphite Mine Road between Byers Road and Graphite Mine Road's northern terminus at PA Route 100 (SR100).

Exceptions.

(1)

This section shall not apply to emergency vehicles or in an emergency driving situation requiring the utilization of an engine brake to protect the safety and property of the public, other motor vehicle operators, pedestrians and the operator and passengers of the motor vehicle involved in said emergency.

(2)

This section shall not apply to vehicles required by ordinance, law or regulation to have such brake retarders/compression-release engine brakes on account of their weight.

This section shall take effect immediately upon its adoption and posting of the required sign notices.

The relevant fine and penalties are set forth in the Motor Vehicle Code of the Commonwealth of Pennsylvania.[2]

§ 176-10 Construal of provisions.

This chapter serves as a compilation of the Township of Upper Uwchlan's previously enacted vehicles and traffic legislation. This chapter shall be construed as the current and comprehensive regulation of vehicles and traffic within the Township; provided, however, that where valid legislation of the Township was excluded from this chapter, it shall be deemed still effective and enforceable within the Township, and is incorporated herein by reference.
