The purpose of this article shall be to regulate
and control the use and operation of all-terrain vehicles within the
Village, and this article adopts the provisions of Wis. Stat. § 23.33
and the rules promulgated by the Department of Natural Resources thereunder
in strict conformity therewith as though fully set forth herein, pursuant
to Wis. Stat. § 23.33(11).
No person shall use or operate an all-terrain
vehicle in violation of the provisions of Wis. Stat. § 23.33
and Wis. Admin. Code Ch. NR 64. Said provisions, as set forth in Wis.
Stat. § 23.33(4), do not allow operation of an all-terrain
vehicle adjacent to the roadway except on established all-terrain
vehicle trails, or on the roadway except in certain circumstances.
Subject to the exceptions set forth in Wis. Stat. § 23.33,
no person may operate an all-terrain vehicle on or adjacent to any
Village street, nor or on any sidewalk, pedestrian way or mall. All-terrain
vehicles may only be operated adjacent to or on highways lying in
the Village if the operation is in conformance with Wis. Stat. § 23.33.
There are no all-terrain vehicle trails or trails in the Village.
Pursuant to Wis. Admin. Code s. NR 64.07 and
Wis. Stat. § 23.33(3)(c), no person shall operate an all-terrain
vehicle in any Village park or on any other land owned by the Village.
Notwithstanding the provisions set forth in §§ 219-20 and 219-21, all-terrain vehicles may be operated in the Village pursuant to a special event permit issued under §
188-1.
