A.
No
member of the Town Board, officer, employee or consultant of the town
shall have any interest, financial or otherwise, directly or indirectly,
or engage in any transaction or professional activity which is in
substantial conflict with the proper discharge of his duties.
B.
No
member of the Town Board, officer, employee or consultant of the town
shall represent private interests before any agency of town government
of which he is a member, by which he is employed or to which he renders
consulting services.
To the extent that he knows thereof, a member of the Town Board
and any officer or employee of the Town of Neversink, whether paid
or unpaid, who participates in the discussion or gives official opinion
to the Town Board on any legislation before the Town Board shall publicly
disclose on the official record the nature and extent of any direct
or indirect financial or other private interest he has in such legislation.
No member of the Town Board, officer, employee or consultant
of the town, whether paid or unpaid, shall disclose confidential information
acquired by him in the course of his official duties, nor use such
information to advance his financial or other private interest.
A.
No
member of the Town Board, officer, employee or consultant of the town
should accept other employment which will impair his independence
of judgment in the exercise of his official duties.
B.
No
member of the Town Board, officer, employee or consultant of the town
should accept employment or engage in business or professional activity
which will require him to disclose confidential information gained
by reason of official position or authority.
C.
No
member of the Town Board, officer, employee or consultant of the town
should use or attempt to use his official position to secure unwarranted
privileges or exemption for himself or others.
D.
No
member of the Town Board, officer, employee or consultant of the town
should engage in any transaction as a representative of the town or
a town agency with any business entity in which he has direct or indirect
financial interest that might reasonably tend to conflict with the
proper discharge of his official duties.
E.
No
member of the Town Board, officer, employee or consultant of the town
should, by his conduct, give reasonable basis for the impression that
another can improperly influence him or unduly enjoy his favor in
the performance of official duties or that he is affected by kinship,
rank, position or influence of any party or person.
F.
No
member of the Town Board, officer, employee or consultant of the town
should invest or hold any investment directly or indirectly in any
financial, business, commercial or private transaction which creates
a conflict with his official duties.
G.
No
member of the Town Board, officer, employee or consultant of the town
should, after his termination of service or employment with any board
or agency of the town, appear before any board or agency of such in
relation to any case, proceeding or application in which he personally
participated during the period of his service or employment or which
was under his active consideration.
In addition to any penalty contained in any other provision
of law, any person who shall knowingly and intentionally violate any
of the provisions of this code may be fined, suspended or removed
from office or employment, as the case may be, in any manner provided
by law.
A.
There
is hereby established a Board of Ethics consisting of five members
to be appointed by the Town Supervisor and who shall serve without
compensation and at the pleasure of the Town Board. The majority of
such members shall be persons other than officers or employees of
the Town of Neversink or any municipality wholly or partially located
within the Town of Neversink, but said Board shall include at least
one member who is an elected or appointed officer or employee of the
town.
B.
The
Board of Ethics shall have the powers and duties prescribed by Article
18 of the General Municipal Law, and shall render advisory opinions
to the officers and employees of the Town of Neversink on a confidential
basis with respect to Article 18 of the General Municipal Law and
the Code of Ethics hereby adopted. In addition, the Board may make
recommendations with respect to the drafting and adoption of amendments
to said code. The Board shall adopt such rules and regulations as
it may prescribe and have the services of the Town Attorney as its
counsel.
