There is hereby established an Agency to be
known as the "Harbor Improvement Agency." The Agency shall consist
of nine members, not more than five of whom shall be registered members
of the same political party, to be appointed and to serve as follows:
seven shall serve for three-year term and two shall be members of
the Common Council of the City to serve during their terms on the
Council and shall not be registered members of the same political
party. All members of the Agency, except for the members from the
Common Council, shall be appointed by the Mayor with the consent of
the Common Council. The Agency shall elect its own Chairman, Secretary
and subcommittees.
The Harbor Improvement Agency is hereby designated,
in accordance with C.G.S. § 22a-113k, to function as the
City of Middletown's Harbor Management Commission. The area of City
jurisdiction for harbor management purposes in accordance with C.G.S.
§ 22a-113k shall be the tidally influenced waters of the
Connecticut, Mattabasset, and Coginchaug Rivers waterward of the mean
high water mark and within the corporate limits of the City. This
area of jurisdiction shall be known as the "City of Middletown harbor
management area."
A.Â
It shall be the duty of said Agency to initiate and
implement, in cooperation with appropriate City agencies, plans, specifications
and estimates for the full development and beautification of the waterfront
area which lies along the banks of the Connecticut River within the
corporate limits of the City of Middletown. Such plans, specifications
and estimates shall include, but not necessarily be limited to, a
marina, crew club, docking facilities for visiting boats and the establishment
of new park and recreation areas along the riverfront.

Said Agency shall have all of the powers and duties
granted to municipal harbor management commissions by C.G.S. §§ 22a-113k
through 22a-113s, as amended, excepting those powers and duties expressly
conferred upon or reserved for the Common Council by the Charter of
the City of Middletown, Middletown Code of Ordinances or state statute.

Among the powers and duties of said agency shall be
the power and duty to prepare a City Harbor Management Plan for the
most beneficial use of the harbor management area for recreational,
commercial, industrial and other purposes. The Harbor Management Plan
shall be prepared for adoption by the Common Council, review by the
United States Army Corps of Engineers and approval by the Connecticut
Commissioners of Environmental Protection and Transportation in accordance
with C.G.S. §§ 22a-113m through 22a-113o.

It shall be the duty of said Agency to advise and
assist in the coordination of all public and private agencies, departments,
commissions and other organizations that provide a service or function
affecting the harbor management area and adjoining waterfront.
