The Sanitary Disposal District shall constitute that portion of the City lying within the boundaries of the former first taxing district, together with any other territory contiguous thereto which has been, or may hereafter be, added in accordance with the Middletown Charter.[1]

The Director of Public Works shall make all regulations necessary or appropriate for the orderly collection of solid waste within the Sanitary Disposal District. Each regulation shall be in writing and shall become effective upon publication in a newspaper having a general circulation in Middletown and filing of a copy with the City/Town Clerk.

Unless otherwise provided by the Common Council, the rents, fees or charges as may be necessary to effectuate the collection of garbage and refuse, as proposed by the Sanitation District Commission of the City of Middletown and the Public Works Commission, are hereby approved and on file in the Department of Public Works.

A. 
Billing shall be made twice per year in advance. This semiannual billing shall be issued on May 1 and November 1 of each calendar year.
B. 
It shall be the responsibility of the property owner to pay for the refuse service. Property owners shall be responsible for payment regardless of whether a bill is received. It shall be the property owner’s responsibility to identify and protest incorrect bills to the Sanitation District within the month (May or November) that such bill is issued. Any incorrect bills so identified shall be corrected and reissued by the Sanitation District.
C. 
In the event that a building is empty or unoccupied, it shall be the property owner’s responsibility to notify the City Public Works Department in writing within 30 days of such vacancy. The Sanitation Commission may authorize a refund of fees in such event; however, such a refund shall be limited to one billing cycle from the date of vacancy. The Sanitation Commission may require such proof as it reasonably deems appropriate prior to authorizing the issuance of a refund. The property owner shall notify the Sanitation District within 30 days of a new occupancy. In preparation of the semiannual billing, any annual fee or rate that is divided by two for the six-month charge shall be rounded down to the nearest one-hundredth of a dollar.
