A. 
Each user shall provide protection from accidental discharge in violation of this chapter.
B. 
For countermeasures to be taken by the city to minimize damage to the sewerage system and receiving waters, users shall notify the Department of Public Works immediately upon accidentally discharging wastes in violation of this chapter.
C. 
This notification shall be followed, within 15 days of the date of occurrence, by a detailed written statement describing the causes of the accidental discharge and the measures being taken to prevent future occurrences. Such notification will not relieve users of liability for any expense, loss or damage to the system, or for any fines imposed on the city on account thereof.
D. 
In order that employees of commercial and industrial users be more fully informed, copies of this chapter shall be made available to all employees of these users. A notice shall be furnished and permanently posted on the user's bulletin board advising employees whom to call in case of an accidental discharge in violation of this chapter.
When the Director of Public Works finds that a discharge of wastes has been taking place, or threatens to take place, in violation of prohibitions or limitations of this chapter, the Director of Public Works may issue an order to cease and desist, after giving notice to the discharger and allowing him a reasonable opportunity to respond, and may direct that those persons not complying with such prohibitions, limits, requirements or provisions:
A. 
Comply forthwith;
B. 
Comply in accordance with a time schedule set forth by the Director of Public Works; or
C. 
Take appropriate or remedial preventative action in the event of a threatened violation.
When the Director of Public Works finds that a discharge of wastes has been taking place, or threatens to take place, in violation of prohibitions or limitations prescribed in this chapter, the Director of Public Works may require the user to submit for approval, with such modifications as it deems necessary, a detailed time schedule of specific actions that the user shall take in order to prevent or correct a violation of requirements.
Any user affected by any decision, action or determination, including cease and desist orders made by the director of Public Works interpreting or implementing the provisions of this chapter, may file with the City Manager a written request for reconsideration within 10 days of such decision, action or determination, setting forth in detail the facts supporting the user's reconsideration.
Any industrial user who violates the conditions of this chapter, or applicable state and federal regulations, is subject to having the industrial discharge permit agreement revoked, as set forth in Article VIII, Enforcement, Remedies, Affirmative Defenses and Charges, in this chapter.

If any person discharges sewage, industrial wastes or other wastes into the city's wastewater disposal system contrary to the provisions of this chapter, federal or state pretreatment requirements or any order of the city, the city may commence an action for appropriate legal and/or equitable relief in the appropriate court.
