[Adopted 5-16-1978 by L.L. No. 4-1978]
As used in this article, the following terms shall have the meanings indicated:
TOWN PARK
Lands owned or used by the Town of Niskayuna for the purpose of operating and maintaining thereon a park area, recreational area or hike-and-bike trail.
The following rules, regulations and restrictions shall be applicable to all Town parks:
A. 
No one shall throw, break or dispose of any bottle, tin can, paper, clothes, rubbish or offal of any description in any park under the jurisdiction or control of the Town Board. All items and refuse brought into a Town park shall be carried out (carry in/carry out).

B. 
No one shall destroy, deface, remove, injure or tamper with any object, item or material in any Town park or damage, deface or destroy any drive, path, walk, parking lot, structure, building or any appurtenance connected with the park or other property or equipment, real or personal, owned by the Town or under the jurisdiction and control of the Town Board.
C. 
No one shall kindle, build, maintain or use a fire within the confines of any park except in park grills provided there for the preparation of food.
D. 
Drug and alcohol restrictions; special permit requirements.

(1) 
No one shall have, possess, carry, consume or transport any illegal substance, drug, stimulant, depressant or hallucinogenic agent in or upon any Town parkland or lands under the jurisdiction of the Town Board. No one shall have, possess, carry, consume or transport any liquor, wine, beer or other alcoholic beverage in or upon any Town parkland or lands under the jurisdiction of the Town Board, except by special permit from the Recreation Department of the Town of Niskayuna.

(2) 
All persons or groups requesting a special permit for the above purposes shall be required to submit proof of personal liability insurance in the amount of $500,000, which shall remain in effect at all times during which the application permits the use of alcoholic beverages on Town property. If the special permit for use of alcoholic beverages on Town property is in conjunction with a catering service, then the caterer shall be required to provide liquor legal liability insurance in the amount of $1,000,000 per occurrence/$2,000,000 aggregate, in compliance with the Dram Shop Act.
E. 
All Town park areas shall be closed from 1/2 hour after sunset to 1/2 hour after sunrise, except for areas lighted by the Town for approved activities.

F. 
Golfing shall not be allowed within the confines of any park under the jurisdiction of the Town Board, except for the driving range.

G. 
The use of off-road motorized vehicles of any type is expressly prohibited within the confines of any park under the jurisdiction of the Town Board.

H. 
Smoking, vaping, or the use of e-cigarettes is expressly prohibited within the confines of any Niskayuna Town park. "Smoking" means inhaling, exhaling, burning or carrying any lighted cigar, cigarette, pipe, or any form of lighted object or device which contains tobacco. "Vaping" means the use of an electronic cigarette. "Electronic cigarette" means electronic devices that deliver nicotine to the user. These devices do not contain tobacco; rather, they heat up liquid nicotine and emit vapor.

I. 
The use of bows, including but not limited to longbows, crossbows, compound bows or recurve bows, is expressly prohibited within the confines of any park under the jurisdiction of the Town Board unless such use is for a competition or for instructional purposes and expressly approved by the Town.

The Town of Niskayuna will not be responsible for loss, damage or theft of personal property on or from Town parks or lands under the jurisdiction of the Town Board. Such loss shall be the patron's responsibility.
All state and local laws and/or ordinances of the Town of Niskayuna and the State of New York shall form or constitute a part of this article. However, such additional directions for traffic and motor vehicles as may be posted on signs shall be regarded as part of this article for traffic control.
The speed limit in any Town park shall be 15 miles per hour.

Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
