GENERAL REFERENCES
Building construction — See Ch. 146.
The installation and/or use of grates, gates, grilles and/or
shutters on the exterior of any commercial property is prohibited.
The installation and/or use of grates, gates, grilles and/or
shutters on the interior of a commercial property is permitted, but
only if the following conditions are met:
A.Â
The surface area of the grate, gate, grille and/or shutter shall
not be solid, and shall contain openings which permit the passage
of air and light through at least 30% of the surface area.
B.Â
The grate, gate, grille and/or shutter shall be accessible by fire
and/or rescue personnel by means of key, code, password, or the like.
C.Â
Prior to installation, the owner of the commercial property shall:
(1)Â
Provide the Borough Manager and Borough Fire Marshal with detailed
plans and specifications pertaining to the proposed installation;
and
(2)Â
Obtain written approval by the Borough Fire Marshal of the proposed
installation; and
(3)Â
Comply with all other state, federal and local laws, regulations
and ordinances, including but not limited to those relating to building
permits.
D.Â
Upon completion of installation, the owner of the commercial property
shall provide the Lansdowne Fire Company with the key, code, password,
or the like which is necessary for fire and/or rescue personnel to
gain access through the grate, gate, grille and/or shutter.
Grates, gates, grilles and/or shutters which are in existence
as of the effective date of this chapter, and that would otherwise
be prohibited by this chapter, shall be permitted, provided that they
otherwise comply with federal, state, and local laws, regulations
and ordinances. However, whenever the use of a commercial property
changes and/or whenever the commercial property is the subject of
substantial renovations, the commercial property shall not be subject
to exemption from the requirements of this chapter.
As used in this chapter, the following terms shall have the
meanings indicated:
Refers to a property, or any portion thereof, which is used
for nonresidential purposes.
Includes but is not limited to any device which is designed
or intended to cover all or part of a window opening, door opening
and/or window/door opening, regardless of:
A.Â
Nothing in this chapter shall be interpreted to permit the installation
and/or use of grates, gates, grilles and/or shutters in or on residential
properties.
B.Â
All other ordinances which are inconsistent with this chapter are
hereby repealed.
C.Â
This chapter shall be effective immediately and shall apply to all
commercial properties which presently exist and which are constructed
and/or renovated in the future.
