Pursuant to the provisions of Article 14-F of the General Municipal Law of the State of New York entitled "Sewer Rent Law" (Chapter 765 of the Laws of 1951) and any and all amendments thereto, there are hereby established and imposed sewer rents as a means of producing revenue for the sewer system and sewage treatment plant of the City of North Tonawanda.
Unless the context shall otherwise require, the terms, phrases, words and their derivatives used in this local law shall have the same meanings as those defined in Chapter 75 of the Code of the City of North Tonawanda, Article I, entitled "Sewer Use and Industrial Waste Pretreatment."
The City of North Tonawanda hereby establishes sewer rents for use of the sewer system and imposes such sewer rents as a charge on the real property within the City.

A. 
The sewer rent for and thereafter is established according to a formula wherein the capital costs for such sanitary sewer system are recovered 100% from water consumption through the sewer fund, and the costs of operation and maintenance of the sewage treatment system are recovered 100% from water consumption through the sewer fund.
B. 
Billing schedule, additional charges.
(1) 
A minimum sewer charge of $15 per quarter is established and the gallons of consumption used associated with minimum will be zero.
(2) 
The sewer rent for 2021 and thereafter for meter consumption shall be $5 per 1,000 gallons of water consumption and shall be assessed and collected in conformance with the following schedule:

The sewer rent rate for 2021 for unmetered consumers shall be a flat rate charge of $10.96 per equivalent fixture unit per year, to result in the following schedule of charges:

D. 
A 10% surcharge shall be placed on all sewer rent account balances that are due in September and remain unpaid by mid-November of each year and shall be levied on the subsequent year real property tax bill.
E. 
Multi-dwelling-unit homes and apartments that have only one master water meter would be subject to the existing $15 minimum sewer charge and would receive an additional minimum sewer charge of $12 for each additional dwelling unit which does not have a water meter.

Such sewer rents shall be due and payable quarterly and shall accompany the water billing to the premises connected with and served by the sewer system or such part or parts thereof.
Penalties for late payment of sewer rents shall be the same as presently assessed for arrears of water service as provided in § 98-7 of the Code of the City of North Tonawanda.
A. 
Such unpaid rents, together with the penalties prescribed by this local law, shall be a lien upon the real property connected with and served by the sewer system, or such part or parts thereof, and such lien is prior and superior to every other lien or claim, except the lien of an existing tax or water service charge.
B. 
The Common Council may bring and maintain an action in the name of the city for the foreclosure of liens for such sewer rents, or the Common Council may certify the amount of any such lien which has not been paid at the time and in the manner prescribed by said local law, with a description of the real property affected thereby, and the City Treasurer shall include such amount in the annual tax levy and shall levy the same upon the real property in default.
This local law shall take effect upon filing with the Secretary of State.
