GENERAL REFERENCES
Permanent Building Committee — See Ch. 18.
There is hereby established a Public Site and Building Commission for the purpose of aiding and advising the Board of Selectmen in studying the current public building needs and planning for the future space and public building needs of the Town, including those of the educational facilities; to study current public building locations and potential public sites; to consolidate the design and construction of all public buildings, including educational facilities.
A. 
Permanent members.
(1) 
The Public Site and Building Commission established pursuant to § 20-1 shall be composed of seven members appointed by the Board of Selectmen with not more than four of who shall be members of the same political party.
(2) 
The term for the initial appointment of Commission members appointed by the Board of Selectmen shall be as follows: three members for two years; two members for three years; two members for four years; thereafter, the Board of Selectmen shall appoint said Commissioners whose terms have expired for a period of four years.
(3) 
Each Commissioner shall hold office until a successor is appointed and qualified, and the Board of Selectmen shall fill all vacancies on said Commission and may remove any such member for cause.
(4) 
The Commission, excluding any temporary members, shall appoint its own Chairman and Secretary and establish its own rules and regulations for the conduct of its meetings and shall maintain a record of each meeting.
B. 
Temporary members. Upon the Board of Selectmen assignment of specific projects to the Commission, the Board of Selectmen may appoint up to two temporary members to the Commission to represent the "user's interest" in the project. Such temporary members shall serve until final completion of said project or termination by the Board of Selectmen. If more than one temporary member is appointed by the Board of Selectmen, no more than one of such temporary members shall be of the same political party. Such temporary members shall participate and vote in meetings of the Commission only on matters relating to the specific assignment for which they were appointed.
A. 
Authority to act. The Commission shall be responsible for the study, design and construction for those public buildings or projects, the acquisition and use of real property and/or other buildings, whether existing or proposed, including educational facilities, that are specifically authorized and assigned by the Board of Selectmen to the Commission.
B. 
Authority to contract. The Commission has no authority to contract with and/or expend monies in connection with any authorized and assigned project, without the necessary approval of appropriations for the same from either and/or the Board of Selectmen, Board of Finance or the legislative body of the Town of Bethel as the case may be, pursuant to the provisions of the Charter of the Town of Bethel.
A. 
Feasibility studies.
(1) 
When assigned by the Board of Selectmen, the Commission may assist other offices, boards, agencies and/or officers of the Town or on its own develop feasibility studies of public buildings, acquisition and use of real property and/or other projects.
(2) 
The Commission shall make recommendations to the Board of Selectmen for any and all contracts for such feasibility studies. The Commission shall also see to it that such contracts shall be in writing and approved by the Board of Selectmen as to form and content.
B. 
Design phase.
(1) 
The Commission shall study sites and building locations for such public buildings or projects as may be assigned by the Board of Selectmen. In consideration of such sites and locations, the Commission shall coordinate and review its study with other offices, boards, agencies and/or officers of the Town.
(2) 
The Commission, after comparing firms and individuals and interviewing the same for their qualifications, shall select an architect and/or others for professional services which may be required for each such public building project or other project for recommendation of hire to the Board of Selectmen.
(3) 
The Commission shall see to it that all contracts for said firms, architectural and/or others for professional services shall be in writing and approved by the Board of Selectmen as to form and content.
(4) 
The Commission shall prepare and oversee the schematic designs, final drawings, plans and reasonable cost estimates for each building project or other project.
C. 
Construction phase.
(1) 
The Commission shall aid in the preparation and seeking of competitive bids for the construction of each project. All bids obtained shall be referred to the Board of Selectmen with recommendations for their acceptance or rejection.
(2) 
Subject to approval by the Board of Selectmen, the Commission shall arrange for the supervision of each project during construction, including but not limited to the hiring of a clerk of the works, general contract manager, etc. Such supervision shall include but not be limited to overseeing and observing the work and materials as often as may be necessary with respect to quality, suitability and adherence to the contract drawings, specifications and other contract documents for the protection of the Town against defects and deficiencies in the work of the contractor and materials supplied by the contractor.
(3) 
The Commission shall see to it that all contracts for the successful bidder and for the supervision of the project shall be in writing and approved by the Board of Selectmen as to form and content.
(4) 
During the construction phase of each project, the Commission shall provide at a minimum one written quarterly report to the Board of Selectmen regarding the status and progress of the project.
(5) 
In addition, the Commission, on a quarterly basis, with the aid of the office of the Comptroller, shall account to the Board of Selectmen, in writing, for all expenditures and expenses of the project to date pursuant to the appropriation of the same.
D. 
Completion of project.
(1) 
When a final certificate of occupancy and/or certificate of compliance has been issued by the Building Department of the Town, if said permit is so required, and the public building or project has been completed, the Commission shall render a final written report concerning the same to the Board of Selectmen and, with the aid of the office of the Comptroller, a final written accounting to date of all expenses made pursuant to the appropriation for the same.
(2) 
When the Commission's final report and accounting of the project have been accepted by the Board of Selectmen, the Commission shall turn the building and/or project over to the appropriate Town body/agency and shall notify such body/agency and the Board of Selectmen of such acts in writing.
E. 
Termination of project. The Board of Selectmen may terminate any assigned project to the Commission at any time. Upon such termination, the Commission shall present a final report to date and should moneys have been expended, a final written account to the Board of Selectmen for its acceptance. Upon acceptance by the Board of Selectmen, the Commission's responsibility for said project shall cease.
