As used in this chapter, the following terms shall have the meanings
indicated:
BUILDING OFFICIAL
The Building Official of this municipality or his authorized representative.
CONSTRUCTION CONTAINER
A metal box, roll off with open top, not to exceed 264 inches in
length by 66 inches wide by 66 inches high (30 cubic yards).
DEP
The Connecticut Department of Environmental Protection.
DUMPSTER
A metal box, front and rear end loader with cover, not to exceed
36 inches in length by 72 inches wide by 38 inches high (two cubic yards).
RECYCLABLE MATERIALS
Any item designated by the DEP or the Town which can be separated
or diverted as defined under "recycling."
RECYCLING
The separation or diversion of an item or items from the solid waste
stream for the purposes of processing it or them or causing it or them to
be processed into a material product, including the production of compost,
in order to provide for the disposition of the item or items in a manner,
other than incineration or landfilling, which will best protect the environment.
Nothing in this definition shall preclude the use of waste oil as fuel in
an oil burner.
RESIDENTIAL PROPERTY
Real estate containing one- or two-family living units, but shall
not include apartments or condominiums.
There is hereby established a chapter that will restrict the placement
of a dumpster and/or construction container upon one- and two-family residential
property within the Town.
The placement of a dumpster and/or construction container must have
the approval of the Building Official of the Town and shall not block the
flow of vehicular traffic or pedestrian traffic and shall not be loaded in
such a manner as to cause its contents to spill into the street or sidewalk
areas.
The use of the dumpster and/or construction container shall not contain
any recyclable materials or garbage. Contents placed in the container shall
not create offensive odors or a health hazard.
All permits shall be in writing and issued by the Building Official.
The Building Official shall issue said permit if it appears that the applicant
has reasonable need to use a dumpster and/or construction container.
Any permit granted pursuant to this chapter may be revoked by the Building
Official for the following reasons:
A. The permit holder has made any false statements in his
application for a permit.
B. The permit holder fails to use the dumpster/container
as requested from the Building Official.
C. The permit holder fails to conform to the provisions
set forward in this chapter.
