As used in this chapter, the following terms shall have the meanings
indicated:
Any assembly, exhibition, fair, display or show, including Ferris
wheels, merry-go-rounds, amusements, games of chance or skill, feats of horsemanship,
exhibitions, performances or sales of goods, for charitable benefits grouped
together and carried on for a short period of time in the open air or under
temporary structures or elsewhere.
No bazaar, fair, concert, exhibit, show or carnival shall be operated
within the Township of Boonton without a license being first obtained in the
manner hereinafter described, and the same shall not be operated in Boonton
Township without prior approval of the Township Committee.
A.
Any person, group of persons, association, corporation
or other entity desiring a license to conduct one of the events enumerated
above shall first present an application to the Township Clerk, setting forth
the name, address, purpose for which such license is requested, the association,
business, entity or group the applicant represents, the dates and hours of
the events and consent of the owner of the property where the proposed venture
will be conducted.
B.
Such application shall be accompanied by a license fee as set forth in Chapter 82, Fees.

C.
The application shall be referred to the Chief of Police
of the Township of Boonton or his agent for comment and approval regarding
permission for particular activities and impact on traffic, peace and safety
of the residents of the Township. Such application shall be presented at least
15 days prior to the meeting of the Township Committee at which meeting the
application is to be considered.
A.
Applications for a license must be accompanied by a cash
bond in the amount of $1,500 prior to approval by the Township Committee.
The cash bond amount can be amended, established or waived by the Township
Committee. Such bond shall obligate the applicant to care for the condition
of the facility and to guarantee general cleanup within 24 hours of termination
of the event.
B.
A certificate of insurance covering public liability
coverage in an amount of not less than $1,000,000 for any one accident at
the time such event will be operating shall be delivered as well as workmen's
compensation and comprehensive insurance as deemed adequate by the Township
Committee.
C.
The applicant will provide for and specify arrangements
for first aid, emergency, security and fire protection during the period of
the work, which arrangements shall be reviewed by the Chief of Police and
Fire Chief and thereafter approved by the Township Committee.

Any person who violates any provision of this chapter shall be subject, upon conviction, to the penalties provided in § 1-15 of this Code.
