It shall be unlawful for any person, firm or corporation to possess, store or use dynamite or other explosives within the Township of Boonton without first having obtained a permit for said purpose from the Township Clerk as hereinafter specified.
A. 
Any person, firm or corporation desiring a permit for the possession, storage or use of dynamite or other explosive shall make written application to the Township Clerk. Said application shall contain the following information:
(1) 
The name and address of the person or persons who will actually use, possess or store the explosive, together with a certification that the person using, possessing or storing the explosive is or are duly licensed by the State of New Jersey for said purpose.
(2) 
The quantity and type of explosive material to be possessed, stored or used.
(3) 
The location of the property where the dynamite or other explosive material is to be possessed, stored or used.
(4) 
The length of time the dynamite or other explosive is to be possessed or stored.
(5) 
A certification that the applicant has compensation and liability insurance, the latter in the amount of $100,000/$300,000 with property damage coverage in the amount of $50,000.
B. 
In the event that a permit is sought for the use of dynamite or other explosive material, the following additional information must be stated in the application:
(1) 
The specific time, place and purpose of said explosion.
(2) 
A complete description of the blast, its area and the type of material that is to be blasted.
(3) 
A complete description of the blast, which shall include the type and quantity of material to be used, the position of the explosive material and the type of detonating.
(4) 
A complete description of all the safety measures that will be taken to protect persons and property.
(5) 
A statement that adequate blasting mats and timbers will be used to cover the blast area and that they will be securely anchored.
Upon receipt of such application, duly completed in accordance with the requirements of § 79-2 above, and upon receipt of the permit fee as hereinafter specified, the Township Clerk may issue such permit.

There is hereby established a fee for each permit required under this chapter, which fee shall be paid to the Township Clerk at the time the application is made and which fee shall be as set forth in Chapter 82, Fees.
It shall be unlawful to use dynamite or other explosives between the hours of 6:00 p.m. and 8:00 a.m. and on Sundays.
The possession, storage and use of dynamite or other explosives shall conform with the legal requirements of the State of New Jersey with respect thereto.
All permits granted hereunder may be revoked at any time by the Township Committee of the Township of Boonton.

Any person, firm or corporation violating any of the provisions of this chapter shall be subject, upon conviction, to the penalties provided in § 1-15 of this Code. Each day dynamite or other explosives are possessed, stored or used in violation of this chapter shall constitute a separate offense.
