Any person, firm or corporation, whether or
not holding a soil movement permit, shall comply with the requirements
of this article with respect to the movement of soil from any premises
within the Township of Boonton.
All vehicles carrying soil on and off of the
premises shall be loaded and covered in such a manner that the soil
being transported will not be blown or dropped off within the boundaries
of the Township of Boonton.
The conduct or the final result of the soil
movement operation shall not create any sharp declivities, steep embankments,
unpermitted pits or depressions, soil erosion or soil fertility problems,
depressed land values, drainage or sewerage problems or conditions
of danger.
Temporarily hazardous conditions created of
necessity and by permission, such as sedimentation basins or other
declivities more than two feet deep, shall be fenced to a height of
not less than four feet with chain-link fencing on steel posts until
filled to approved permanent grade.
All topsoil shall be retained on the premises,
except as otherwise provided herein, until completion of the soil
removal project. Topsoil may be removed from the premises only pursuant
to specific approval by the Township Committee and only to the extent
that it is not needed to cover the sites of proposed improvements
duly authorized to be made pursuant to the zoning and subdivision
or road opening regulations to a compacted depth of at least four
inches.
During soil movement operations, a buffer strip
shall be maintained between the premises on which soil is being moved
and all adjoining premises of such width as shall be approved by the
Township Engineer as being sufficient to protect the adjoining premises
from water runoff, dust and excessive noise, unless the owner of the
adjoining premises consents, in writing, to the applicant and to the
Township Committee to the elimination of such buffer strip. Final
grading work on any buffer strip shall be completed only after completion
of all other soil removal operations on the premises. When work is
commenced on the buffer strip, it shall proceed continuously without
interruption until completed and the buffer strip has either been
covered with appropriate ground cover or approved permanent improvements,
as the case may be.
Upon completion of soil movement operations,
the area of disturbance shall be properly leveled off, cleared of
debris, graded to conform to the finished contour lines of the grade
map as approved, and, except for those areas on which work on approved
roads, buildings or other improvements is to commence within 60 days,
covered with topsoil to a compacted depth of four inches and planted
forthwith with appropriate ground cover.
