GENERAL REFERENCES
Dogs (Township Committee) — See Ch. 71.
No person shall keep, raise or harbor more than two pet animals other
than household pets on any premises of less than five acres owned, leased
or used by them within the Township of Boonton, except as herein provided.
Any person desiring to keep, raise or harbor more than two pet animals
within the Township of Boonton shall first apply to the Board of Health of
the Township of Boonton for a special permit authorizing the same. The application
shall contain the following information: a sketch of the premises upon which
the animals are to be kept, which sketch shall indicate all buildings on the
premises, the area to be occupied by the animals, proposed fences and enclosures
and the type and number of pet animals to be kept.
A.
No permit shall be issued for the keeping of more than
two pet animals within the Township of Boonton unless the premises on which
the animals are to be kept comply with the following conditions:

No manure or urine shall be stored within 50 feet of
the property line of the premises on which the animals are kept, nor within
50 feet of any dwelling on the property either adjoining or adjacent or in
the approximate vicinity of the property on which the animals are kept, nor
within 50 feet of any well which supplies water for human consumption.
B.
As a condition for the obtaining and retention of a permit
for the keeping of more than two pet animals within the Township of Boonton,
the premises on which said animals are to be kept shall be subject to an inspection
by the Sanitary Inspector of said Township during reasonable hours to assure
compliance with this chapter.
A.
The Board of Health shall consider the application and
conduct such investigation as it may determine to be necessary in order to
ascertain the extent to which the proposed use may affect the health, safety
or welfare of the applicant and other persons in the community.
B.
The applicant, if he so requests, shall be entitled to
appear before the Board of Health and present such evidence in support of
the application as may be proper. Within 45 days after the filing of the application,
the Board of Health shall issue its determination as to whether the permit
shall issue, and, if the application is denied, a statement of the reasons
for denying the same shall be mailed to the applicant at the address shown
on the application.

If at any time after the issuance of a permit the Sanitary
Inspector of the Township of Boonton determines that the conditions of the
permit have been violated, he shall order the permit to be revoked.
B.
In the event that any of the provisions of this chapter
are violated, the Board of Health may terminate or suspend any permit issued
pursuant to this chapter.
C.
Written notice of the alleged violations shall be given
to the applicant, to any employee of the applicant on the licensed premises
or by posting the notice on the premises in a conspicuous place. The written
notice shall include the time and place of the hearing, which shall not be
less than 30 days after the notice.
D.
At the hearing, the Board of Health shall hear all the
evidence offered in connection with the proposed suspension or revocation.
The Board of Health, if it finds against the permittee, may revoke the permit
or may suspend it upon such conditions and stipulations as may be directed.
In the event of revocation of the permit, the animals shall no longer be kept
upon the premises.
A.
Any person, partnership, corporation, organization or
group who shall keep, raise or harbor more than two pet animals in violation
of this chapter shall, upon conviction, be subject to a fine of no more than
$500. nor less than $5.
B.
Each day a particular violation continues shall constitute
a separate offense.
