As used in this article, the following terms shall have the meanings indicated:
ANIMAL RESCUE ORGANIZATION
An individual or group of individuals who, with or without salary or compensation, house and care for homeless animals in the home of an individual or in other facilities, with the intent of placing the animals in responsible, more permanent homes as soon as possible.

ANIMAL RESCUE ORGANIZATION FACILITY
The home or other facility in which an animal rescue organization houses and cares for an animal.

KENNEL
Any establishment wherein or whereon the business of boarding, breeding or selling dogs or breeding dogs for sale is carried on, except a pet shop.
PET SHOP
Any place of business which is not part of a kennel, wherein animals, including, but not limited to, dogs, cats, birds, fish, reptiles, rabbits, hamsters or gerbils, are kept or displayed chiefly for the purpose of sale to individuals for personal appreciation and companionship rather than for business or research purposes.

POUND
An establishment for the confinement of dogs seized either under the provisions of this chapter or any other law, or to which dogs may be delivered by the owner.
SHELTER
Any establishment where dogs are received, housed and distributed without charge.
No licensing provision of this article shall be construed to apply to any establishment wherein or whereon dogs are received or kept for diagnostic, medical, surgical or other treatments, owned by and operated under the immediate supervision of a graduate veterinarian licensed in the State of New Jersey.
A. 
No kennel, pet shop, shelter or pound shall be located, established or maintained in the City unless the person who keeps or operates or proposes to establish a kennel, a pet shop, a shelter or a pound shall apply to and obtain from the City Clerk a license entitling him to keep or operate such establishment.
B. 
Any person holding a license issued under Subsection A of this section shall not be required to procure individual licenses for dogs owned by said licensee and kept at such establishment.

A. 
Any person desiring a license under this article shall file with the City Clerk an original and four copies of an application, under oath, in writing, on a form furnished by the City Clerk.
B. 
The application shall set forth the following information:
(1) 
The applicant's name, business name and business address.
(2) 
Whether the applicant is an individual, a partnership, a corporation or another entity, and, if another entity, a full explanation and description thereof.
(3) 
If the applicant is an individual, the applicant's residence address and date and place of birth.
(4) 
If the applicant is a partnership, the full names, residence addresses, dates and places of birth of each partner.
(5) 
If the applicant is a corporation, the full names, residence addresses, dates and places of birth of each major officer and each stockholder, the name and address of the registered agent and the address of the principal office (The term "stockholder," as used herein, means and includes any person owning or having an interest, either legal or equitable, in 10% or more of the stock issued and outstanding of the applicant corporation.); in the case of another entity, the full names, residence addresses, dates and places of birth of each person owning or having an interest, either legal or equitable, aggregating in value 10% or more of the total capital of said entity, the name and address of the registered agent, if any, and the address of the principal office.
(6) 
Whether the applicant or any partners, officers or stockholders thereof have ever been arrested or convicted of a crime, and, if so, the name of the person arrested or convicted, the date of arrest, the crime or charge involved and the disposition thereof. The term "officers," as used herein, means and includes the president, vice presidents, secretary and treasurer of a corporate applicant.
(7) 
The purpose for which the license is to be issued.
(8) 
The address of the place where the licensed establishment shall be maintained.
C. 
Upon receipt of such application, the City Clerk shall submit the same to the Police Department, Fire Public Safety Department, Building Department and Health Department for a report with reference to the compliance or noncompliance of the proposed establishment with municipal and state rules, regulations, statutes and ordinances governing the location of and sanitation at such establishments and the truth of the matters contained in the application. The head of each of said departments shall return the application with his report to the City Clerk.

D. 
Upon return of said application and reports, the City Clerk shall submit the same to the Municipal Council for its consent and approval.
E. 
Upon the consent and approval of the Municipal Council, the City Clerk shall issue such license.
A. 
All licenses issued under this article for a kennel, pet shop, shelter or pound shall state the purpose for which the establishment is maintained and shall not be transferable to another owner or different premises. Such licenses shall expire on the last day of January of each year.
B. 
All such licenses shall be subject to revocation by the City Council on recommendation of the State Department of Health or the City Department of Health, for any failure to comply with the rules and regulations of the State Department of Health or of the City Department of Health governing the same, after the licensee has been afforded a hearing by either the State Department of Health or the City Department of Health.

A. 
The annual license fee for a kennel providing accommodations for 10 or fewer dogs shall be $10, and for more than 10 dogs, $25.
B. 
The annual license fee for a pet shop shall be $10.

C. 
No license fee shall be charged for a shelter or pound.
No dog kept in a kennel, pet shop, shelter or pound shall be permitted off such premises, except on a leash or in a crate or other safe control.
The City Clerk shall forward to the State Department of Health a list of all kennels, pet shops, shelters or pounds licensed by the City within 30 days after the licenses therefor are issued, which list shall include the name and address of the licensee and the kind of license issued.

A. 
Not pet shop in the City of Clifton shall sell or offer for sale a dog or cat.
B. 
Nothing in this section shall be construed to prohibit a pet shop from offering for adoption a dog or cat that has been obtained from a shelter, pound, animal rescue organization or animal rescue organization facility.
C. 
Any person who violations the provisions of § 203-27A shall, upon conviction thereof, be punished by a fine not exceeding $500. Each sale or offer for sale shall constitute a separate violation.
