[Adopted 10-2-62 by Ord. No. 3457 (Article 5 of Chapter 9 of the Revised Ordinances of the City of Clifton, New Jersey, 1960)]
As used in this article, the following terms shall have the meanings indicated:
STREET
A cartway or such area as exists between curblines and actually used or intended to be used for the movement of vehicular traffic.
It is hereby certified by the Municipal Council of the City of Clifton that for the purpose of issuing building permits in accordance with and pursuant to N.J.S.A. 40:55-1.39,[1] all streets presently existing in the City of Clifton are deemed to be suitably improved to the satisfaction of the governing body as adequate in respect to public health, safety and general welfare.

It is hereby further certified by the Municipal Council of the City of Clifton that for the purpose of issuing building permits in accordance with and pursuant to N.J.S.A. 40:55-1.39, all streets which hereafter come into existence in the City of Clifton are deemed to be suitably improved to the satisfaction of the governing body as adequate in respect to public health, safety, and general welfare if such street is either improved by the City of Clifton or is improved or constructed by any person, firm or corporation in accordance with specifications prepared by and on file with the City Engineer and which specifications have been approved by the Municipal Council.
This article shall not in any way affect any requirement concerning the improvement or construction of curbs and sidewalks, and the requirement for the improvement or construction of curbs and sidewalks or the assurance of such improvement or construction of curbs and sidewalks shall continue in effect as heretofore; nor shall this article affect the right of the City of Clifton to hereafter permanently improve any street in the City of Clifton and to assess for such improvement as provided by law.
