This chapter shall apply to the aerial spraying process only.
As used in this chapter, the following terms shall have the meanings indicated:
STATE-DESIGNATED AREAS
Those areas designated by the State of New Jersey as being eligible for funding, together with those areas which have been designated by the State of New Jersey as areas in which gypsy moth damage can be expected at high levels.
In state-designated areas, the municipal government, through its duly designated coordinator, shall arrange for the aerial spraying process to take place and the payment therefor by the citizens located in said areas as follows:
A. 
Any and all state and county grant moneys made available for this project shall first be applied to the total cost. The unpaid balance shall then be divided among all of the residents of the township located in those areas that are sprayed. Each property owner shall be financially responsible, based upon the following formula:
(1) 
Each Tax Map lot shall be assessed.
(2) 
Each acre or fraction thereof shall constitute one billing unit.
(3) 
In multiple-dwelling-unit Tax Map lots, each four dwelling units, or fraction thereof, shall constitute one billing unit. The total number of billing units times the amount per billing unit charged will then be divided equally by the total number of units within each Tax Map lot.
B. 
Each bill so rendered to a resident shall be due and payable in full to the Township of Galloway within 30 days from the date of the rendering of said bill. In the event that the bill is not paid as set forth, then the amount of said bill shall appear on the next tax bill, shall appear as a lien against the real estate and shall be subject to interest and any and all other late charges and penalties just as if the same were taxes upon the real estate.
C. 
Any properties which have not been designated to be sprayed by the township or any other governmental agency and whose owners desire to have their properties sprayed aerially may do so under the following terms and conditions only:
(1) 
The spraying may be handled through the Galloway Township coordinator, who will arrange for spraying after a municipal contract for the aerial spraying has been awarded and the parties to be serviced have made payment, in full, in advance to the township.
(2) 
Those persons owning property located outside of the state- or municipally-designated spray areas may make arrangements, without utilizing the township coordinator, to have their property sprayed; provided, however, that said spraying process is accomplished in accordance with state regulations and statutes with respect to the manner of spraying and the type of products used in the spraying process.

Any person who violates this chapter, upon conviction in the Municipal Court of the Township of Galloway, shall be considered a disorderly person and shall be subject to a fine of not more than $2,000, imprisonment for not more than 90 days and/or a period of community service for not more than 90 days. Each day that the violation exists shall constitute a separate violation under this chapter.
