GENERAL REFERENCES

No person or group of persons shall keep or raise swine in the Township of Galloway without a permit or license.
Said permit or license shall be issued by the Investigator of the Board of Health of the Township of Galloway and shall continue in force for the calendar year in which it is issued.
A. 
Application for a permit or license shall be made each calendar year. This shall state and set forth the following information:
(1) 
Name of applicant.
(2) 
Residence and place of business in swine raising.
(3) 
Location of the swinery.
(4) 
Estimated number of swine to be kept or raised.
(5) 
The distance of the swinery or pig house from the house of any person or persons using same as living quarters.
B. 
All fees must accompany the application.
C. 
An application for a permit or license to keep or raise swine must be made each year.
D. 
Every permit or license shall be issued to expire on December 31 of the same year without rebate for any part of a calendar year of which the applicant has failed to avail himself, herself or itself.
A permit or license may be revoked at any time by the Board of Health for the violation of any rules and regulations of the Board, but only on public hearing first had before said Board of Health. Where charges of violation are preferred against a holder of a permit or license, the complainant shall put his complaint in writing and shall specifically set forth the rules and regulations violated. A hearing may be brought on after 15 days' notice. The holder of the permit or license shall be permitted to be attended by counsel. On a hearing, the verdict of the Board of Health shall be final. A complaint may be filed by any person aggrieved.
For the protection of the public health within this jurisdiction, keepers and raisers of swine in the Township of Galloway shall observe the following rules and regulations:
A. 
Every person who hereafter shall be engaged in the business of keeping or raising swine in the Township of Galloway shall have premises of sufficient size and accommodations as to comport with the prevailing health standards in swine raising.
B. 
Pigpens and swinery premises shall at all times be open for inspection by any member or members of the Board of Health or by any Investigator or Investigators appointed by the Board of Health, or its Investigator designated shall make inspection of each and every swinery or pen at least once a year and as often as the exigency may require.
C. 
Manure from pigpens or swineries shall be hauled or carted from the same during the months of October, November, December, January, February and March of each year.
D. 
Persons who shall spread pig manure as fertilizer upon the ground shall see to it that the same is plowed under within 48 hours of such spreading.
E. 
All refuse, manure and remains of garbage shall be removed from the pigpens and piled on the premises at least once in every 24 hours. Such refuse, manure and garbage shall be piled in a suitable place, which shall be fenced off or confined in such a manner that no swine or pigs shall have access to the same.
F. 
Persons who shall haul refuse, manure or garbage through the confines of Galloway Township shall transport or carry same in a suitable truck, and there shall be placed over the refuse, manure and garbage a complete covering. Such trucks used in hauling shall at all times when not in use be kept clean and free from refuse, manure and garbage.
G. 
Every pigpen or swinery must have a proper and suitable drainage to prevent stagnation, and such drainage shall comport with recognized methods of proper drainage to healthful filtration.
The foregoing article shall not apply to such persons known as farmers, whose chief occupation is to engage in cultivating the soil; provided, however, that such farmer shall not keep more than 10 swine or pigs at any one time, and provided further that this article shall not apply to pigs less than eight weeks old.
No swinery shall be closer than 500 feet to any state, county or township road or boundary of any adjacent property, and no swinery shall have more than 1,000 pigs.
A. 
Whenever any person shall violate any section of the foregoing article the informer or party aggrieved may file a complaint with the Secretary of the Board of Health, and if the Board of Health finds the complaint true or the violation a nuisance, the Board of Health shall notify the offender to remove or abate the nuisance at his own cost and expense. In the event the Board of Health's orders are not complied with, the said Board of Health, through its Clerk, may file a complaint before the proper court, and, upon conviction thereof, the violator shall be subject to a fine of not more than $2,000, imprisonment for not more than 90 days and/or a period of community service for not more than 90 days for each offense. Should any person be convicted of three separate violations of this article, the Board of Health of Galloway Township will abate and remove the nuisance forthwith, and such licensee's permit or license shall be forthwith revoked. In any suit for a violation of the foregoing article, the costs are not to be considered as a part of the penalty.

B. 
Any nuisance abated or removed shall be done at the expense of the offender, which expense shall be assessed as a part of the taxed costs.
For the purpose of interpretation of this article, the following words or terms shall have the meanings herein given:
BOARD
The Board of Health of the Township of Galloway.
CALENDAR YEAR
A period of time after 12:00 midnight December 31 to the same hour 12 months thereafter.
NUISANCE
The Board of Health of this township may define what shall constitute a nuisance in its jurisdiction.
PERSON
Includes a corporation, an association and a natural and artificial person.
SWINE
A hog, especially as domesticated. The term shall include "pig."
SWINERY
A place where swine, pigs or hogs are kept or raised; a pigpen.
No person shall transport in one day more than two loads of garbage not exceeding 16 cubic yards in the aggregate, for consumption by pigs, into or through the Township of Galloway, County of Atlantic and State of New Jersey.

Any person who shall violate the provisions of this article shall be subject to a fine of not more than $1,000, imprisonment for not more than 90 days and/or a period of community service for not more than 90 days. Each violation shall constitute a separate offense.
