A. 
There shall be a Department of Public Works, the head of which shall be the Public Works Director.
B. 
The Department of Public Works shall:
(1) 
Be responsible for all matters relating to the construction, management, maintenance and operation of the physical properties of the City other than office supplies, furniture and equipment.
(2) 
Direct and supervise the preparation of plans and specifications and the letting and performance of contracts for all City public works or improvements.
(3) 
Provide all engineering and mechanical services required by any department, office or agency of the City government, except as otherwise directed by the Mayor or Business Administrator.
(4) 
Make all inspections of buses and taxicabs required for issuance of permits and licenses to operate the same within the City limits.
C. 
The positions within the Department of Public Works shall be as set forth in Appendix A, Active Titles in Local Government, included at the end of this chapter.

The Department of Public Works shall consist of the following Divisions:
A. 
Engineering and Operations Division.
B. 
Traffic and Lighting Division.
C. 
Sewer Division.
D. 
Streets Division.
E.

G. 
Automotive Maintenance Division.
H. 
Cable Communications Division.
I. 
Parks and Shade Trees Division.
J. 
Recycling Division.

A. 
Within the Department of Public Works, there shall be the Engineering and Operations Division, the head of which shall be the City Engineer.
B. 
With the approval of the Public Works Director, the City Engineer may designate and appoint an Assistant City Engineer to serve as head of the Division in the absence of the City Engineer.
C. 
Under the direction of the City Engineer, the Engineering and Operations Division shall:
(1) 
Prepare or cause to be prepared plans, designs and specifications for public works and improvements undertaken by the City, either itself or by public contract.
(2) 
Provide and maintain surveys, maps, plans, specifications and control records with respect to public works and facilities owned and operated by the City.
(3) 
Provide technical and engineering advice and assistance to other City departments as needed.
(4) 
Supervise the performance of contracts for public works and certify the amounts due and payable thereunder.
(5) 
Provide, operate and maintain facilities for the collection and disposal of refuse and garbage at such time and in such manner as may be authorized by ordinance.[1]

(6) 
Maintain and be responsible for technical liaison with Passaic County Utilities Authority and all federal, state, county and regional bodies dealing with the disposal of solid waste.
(7) 
Receive applications for and issue street opening permits.
D. 
The positions within the Department of Public Works, Engineering and Operations Division, shall be as set forth in Appendix A, Active Titles in Local Government, included at the end of this chapter.
A. 
Within the Department of Public Works, there shall be the Traffic and Lighting Division, the head of which shall be the Public Works Director.
B. 
The Traffic and Lighting Division shall:
(1) 
Study problems of street traffic congestion and control and streetlighting and recommend to the City Engineer appropriate plans for street improvement and use to satisfy traffic requirements.
(2) 
Construct, install, repair and maintain traffic control signals and other electrically operated signals, excluding the police and fire signal and radio systems.
(3) 
Install, repair and maintain street traffic signs, lines and markers, and check for streetlight outages.
A. 
Within the Department of Public Works, there shall be the Sewer Division, the head of which shall be the City Engineer.
B. 
The Sewer Division shall:
(1) 
Operate, maintain and repair the City's sanitary and storm sewer system, pumping stations, treatment plants, if any, and appurtenances.
(2) 
Maintain and be responsible for technical liaison with the Passaic Valley Sewerage Commission and all federal, state, county and regional bodies dealing with sewage.

A. 
Within the Department of Public Works, there shall be a Streets Division, the head of which shall be the Superintendent of Public Works.
B. 
Under the direction and supervision of the Director, the Streets Division shall:
(1) 
Maintain and repair all City streets, bridges, culverts and drains within the City.
(2) 
Construct and reconstruct streets, roads, bridges, culverts and drains.
(3) 
Treat road surfaces and resurface streets and roads according to such standards and schedules as directed or approved by the City Engineer.
(4) 
Maintain all City streets in a clean and safe condition free of obstructions and hazards and remove snow and ice therefrom as required.[1]

A. 
Within the Department of Public Works, there shall be the Public Property Division, the head of which shall be the Director of Public Property.
B. 
Under the direction and supervision of the Public Works Director, the Director of the Public Property Division shall:
(1) 
Operate, maintain and repair City-owned buildings and properties and provide custodial and janitorial services therefor, including office quarters, waterfront property and all other real estate.
C. 
The positions within the Department of Public Works, Public Property Division, shall be as set forth in Appendix A, Active Titles in Local Government, included at the end of this chapter.

Within the Department of Public Works, there shall be the Automotive Maintenance Division, the head of which shall be the Public Works Director.
B. 
Under the supervision and direction of the Public Works Director, the Automotive Maintenance Division shall:
(1) 
Control the care, use and disposition of motor vehicles owned by the City, other than fire engines and vehicles and other than all police vehicles.
(a) 
Operate or supervise the operation of a garage or garages for the storage, servicing, repair and maintenance of City-owned motor vehicles other than fire engines and vehicles and other than all police vehicles.
(b) 
Supervise any work done by contract for the storage, repair, servicing and maintenance of City-owned motor vehicles or equipment other than fire engines and vehicles and other than all police vehicles.
(c) 
Control the maintenance of motor vehicles owned by the City, other than fire engines and vehicles and other than all police vehicles by maintaining individual vehicle records of mileage, costs of operation and maintenance and replacement schedules.
(2) 
Establish standards and procedures for the control, use and care of all City-owned equipment, materials and supplies in the custody of the Department of Public Works.

A. 
Within the Department of Public Works, there shall be a Cable Communications Division, the head of which shall be the Director of the Department of Public Works.
B. 
Subsequent to the approval of Council of the necessary construction, contracts and leases, the Cable Communications Division, under the direction of the Director of the Department of Public Works, shall supervise the construction and lease of a cable communications system and all appurtenances thereto.
C. 
The positions within the Department of Public Works, Cable Communications Division, shall be as set forth in Appendix A, Active Titles in Local Government, included at the end of this chapter.

A. 
Within the Department of Public Works, there shall be a Parks and Shade Tree Division, the head of which shall be the Superintendent of Parks and Shade Trees.
B. 
Under the supervision and direction of the Superintendent of Parks and Shade Trees, the Parks and Shade Tree Division shall:
(1) 
Trim, plant and care for trees in the public way.
(2) 
Maintain all playing fields, public parks, greens, playgrounds and shade trees in the same and all recreational structures.

A. 
Within the Department of Public Works, there shall be a Recycling Division, the head of which shall be the Recycling Coordinator.
B. 
Under the direction and supervision of the Recycling Coordinator, the Recycling Division shall supervise and operate the recycling program of the City of Paterson.[1]

The following employees in the Department of Public Works shall receive the same clothing allowance, if any, as provided to Department of Public Works supervisors pursuant to a collective bargaining agreement:

The Department of Public Works Superintendent.
B. 
The Department of Public Works Deputy Director.
