As used in this chapter, the following terms shall have the meanings
indicated:
Includes any privately owned dwelling or part of a dwelling or other
place where one (1) or more children under sixteen (16) years of age are placed
or regularly received, for any period of time, unattended by parent, adult
relative or legal guardian, and foster parent care is provided, excepting
those places which are operated, maintained, licensed or regulated or in which
a child is placed, pursuant to statute, by:

The State Board of Child Welfare.
B.Â
The State Board of Education.
C.Â
Any aid society of a properly organized and accredited
church or fraternal society organized for aid and relief to its members.

The license fee for each establishment licensed under
this chapter or the renewal thereof shall be twenty-five dollars ($25.).

Each license issued under the provisions of this chapter
shall expire one (1) year from the date of issuance thereof.
C.Â
No license issued under this chapter shall be transferable
either between persons or premises.
A license issued under this chapter may be revoked or suspended by the
Health Division, after notice and hearing, for a violation of this chapter
or any rules or regulations promulgated under this chapter or when the judgment
of the Health Division is such that the further operation of the boarding
home for children is not conducive to the well-being of the children.
Any person who violates any provision of this chapter shall, upon conviction
thereof, be punished by a fine not to exceed one thousand dollars ($1,000.),
imprisonment for not more than ninety (90) days or a period of community service
for not more than ninety (90) days, or any combination thereof. A separate
offense shall be deemed committed on each day during or on which a violation
occurs or continues.
