No person shall move any house, building or structure over the streets
of the city without having first secured a permit for that purpose from the
Streets Division Superintendent at least ten (10) days before the commencement
of the moving.
A.
Application for a permit shall be made, in writing, to
the Streets Division Superintendent and filed in his office, upon forms supplied
by the city and obtainable at his office.
B.
The application shall be signed by the owner of the building
to be moved and the person to be entrusted with the moving of the same.
C.
The application shall set forth the following information:
(1)
The name and address of the applicant.
(2)
The name and address of the person to be entrusted with
the moving of the building.
(3)
Dimensions of the building.
(4)
Location from which and to which it will be moved.
(5)
The exact route for moving the building.
(6)
The desired time for the commencement of the moving.
(7)
The estimated time for reaching the destination.
D.
The application shall be accompanied by a permit fee
of fifty dollars ($50.).
B.
If there are no objections to the granting of the moving permit by the Streets Division Superintendent or by the officers described in Subsection A hereof by reason of endangering public safety, undue obstruction of traffic, injury or danger to trees along the route, damage to city streets or other property or public utility and fire hazard, the Streets Division Superintendent shall issue the permit, provided that the applicant files a bond as provided in § 165-4 hereof.
A.
Before issuance of a permit under this chapter, the applicant
shall post a surety bond in the amount of five thousand dollars ($5,000.)
made by a surety company duly authorized to transact business in this state
as surety, and the owner of the building to be removed and the person in charge
of the removal of said building as principals.
B.
The bond shall be in a form approved by the Corporation
Counsel and shall indemnify the city against injury or damage to streets,
trees, shrubbery, utilities and all other kinds or types of property within
the city.
No building shall be moved over the streets of the city except between
sunrise and sunset unless specific authority to do so is given by the Streets
Division Superintendent.
Every permit shall be conspicuously displayed upon the vehicle during
the course of any moving.
Unless another penalty is expressly provided herein, any person who
violates any provision of this chapter shall, upon conviction thereof, be
punished by a fine not exceeding one thousand dollars ($1,000.), by imprisonment
for a term not exceeding ninety (90) days or by a period of community service
for not more than ninety (90) days, or any combination thereof. A separate
offense shall be deemed committed on each day during or on which a violation
occurs or continues.
