A.
Upon the effective date of this subsection, all users that submit a sewer connection application, a request for a temporary permit or a request for a letter of authorization shall pay an application fee to the PVSC. This fee will offset, in whole or in part, the administrative costs incurred by the PVSC to review the application or request. If a determination is made that a permit of any type is not required, a portion of the application fee shall be refunded to the user. The PVSC may by resolution revise the schedule of fees to be paid and refunded.
B.
Upon the effective date of this subsection, all users that are issued a permit of any type shall pay a permit fee to the PVSC. This fee will offset, in whole or in part, the administrative costs incurred by the PVSC to monitor the permittee's compliance with the PVSC Rules and Regulations, as well as state and federal regulations, from the effective date of the permit until the permit, temporary permit or letter of authorization expires, is terminated or is revoked. The PVSC may by resolution revise the schedule of permit fees to be paid. A new permit fee shall be paid for each subsequent permit renewed. The permit fee shall be due at the PVSC within ninety (90) days of the effective date of the permit. No portion of this fee shall be reimbursed.
C.
Each industrial user or other user of the PVSC treatment works shall reimburse the PVSC for those costs incurred if a compliance sample is sent to an outside laboratory for an analysis of one (1) or more parameters which the PVSC is not certified to perform. This reimbursement provision does not apply if the PVSC is certified to perform the analysis but does not. This provision can be invoked no more than two (2) times per year per parameter.
D.
Each user against whom a charge is assessed shall remit the amount due within sixty (60) days of receipt of the notice unless specific procedures are established on a case-by-case basis.
If any provision, paragraph, word, section or Article of these Rules and Regulations is invalidated by any court of competent jurisdiction, the remaining provisions, paragraphs, words, sections and Articles not affected shall continue in full force and effect.
All Rules and Regulations and parts thereof inconsistent or conflicting with any part of the Rules and Regulations are hereby repealed to the extent of such inconsistency or conflict.
A.
These Rules and Regulations shall be in full force and effect on the 12th day of August 1982 and supersede those Rules and Regulations previously approved by the PVSC.
B.
A certified copy of the Rules and Regulations shall be filed with the Municipal Clerk of each participating municipality.
