As used in this chapter, the following terms shall have the meanings indicated:
LEGISLATION
All local laws, ordinances and rules and regulations adopted thereunder by the Brookhaven Town Board.
The purpose of this chapter is to authorize public servants of the Town of Brookhaven to issue and serve appearance tickets in connection with violations of local laws, ordinances or rules and regulations of the Town which the public servants are authorized or required to enforce.

The following public servants of the Town of Brookhaven are hereby authorized to issue and serve an appearance ticket and/or a Town of Brookhaven parking summons with respect to the violation of any provision of legislation adopted by the Town Board:
A. 
Town investigators.
B. 
The Director of the Division of Code Enforcement and park rangers assigned to the Division of Code Enforcement.
C. 
Fire Marshals and Fire Inspectors assigned to the Division of Fire Prevention.

D. 
The Division of Environmental Protection: Director, Senior Environmental Planner, Environmental Planner, Chief Environmental Analyst, Principal Environmental Analyst, Senior Environmental Analyst, Environmental Analyst, Environmental Aide, Environmental Technician, Bay Management Specialist II, Bay Management Specialist I, Assistant Waterways Management Supervisor, Waterways Management Supervisor.
E. 
The Commissioner, and sanitation inspectors assigned to the Department of Recycling and Sustainable Materials Management.

F. 
Building inspectors, zoning inspectors, building and zoning inspectors and plumbing inspectors assigned to the Building Division.
G. 
Harbormasters, bay constables and members of the park patrol assigned to the Division of Code Enforcement.
H. 
Engineering inspectors assigned to the Department of Planning, Environment, and Land Management.

I. 
Dog control officers assigned to the Division of Animal Shelter.
J. 
The Commissioner and Deputy Commissioner of the Department of Public Safety, and investigators, noise control officers, guards, security guards, senior security guards, directors and assistant directors assigned to the Department of Public Safety.
K. 
Housing inspectors and building inspectors assigned to the Housing and Human Services Department, except for violations of the New York State Uniform Fire Prevention and Building Code.

L. 
Environmental educators.

An appearance ticket, other than one issued for a parking violation, shall be served in accordance with the provisions within New York State’s Criminal Procedure Law, CPL Article 150.

No Housing Inspector or Building Inspector assigned to the Housing and Human Services Department may file or cause to be filed, with the local criminal court, an accusatory instrument or misdemeanor information charging any person in violation of the New York State Uniform Fire Prevention and Building Code.
