A. 
This article shall be known as the "Town of Brookhaven Department of General Services."
B. 
Definitions. Whenever used in this article, words used in the singular include the plural and vice versa. As used in this article, the following terms shall have the meanings indicated:
COMMISSIONER
The Commissioner of the Department of General Services shall be the chief executive officer of the Department.
DEPARTMENT
The Town of Brookhaven Department of General Services shall perform a major function of Town government.
DEPUTY COMMISSIONER
The Deputy Commissioner of the Department of General Services, in the absence of the Commissioner, shall act generally for and in place of the Commissioner.
RECREATION PROJECT
A structure, property, interest or activity owned, maintained or operated by or under the direction of the Town of Brookhaven or any governmental subdivision or agency thereof, devoted in whole or in part to the provision of leisure time services for youth.
YOUTH
Any person under 24 years of age.
YOUTH PROGRAM
Any recreation project or youth service project.
YOUTH SERVICE PROJECT
Any plan or organized activity, other than a recreation project, which has for its purpose the detection, prevention or treatment of delinquency of youth or other services directed toward youth development and which is operated by or under the direction of the Town of Brookhaven or any governmental subdivision or agency thereof.
A. 
There shall be in the Town of Brookhaven a Department of General Services.
B. 
Department head. The principal executive officer and administrative head of such Department shall be the Commissioner of General Services, who shall be appointed by the Town Board for the terms fixed by law at such salary as may from time to time be fixed by the Town Board. The Commissioner of General Services shall be appointed on the basis of his administrative experience and qualifications for the duties of such office. The Town Board may appoint a Deputy Commissioner of General Services, who shall generally act for and on behalf of the Commissioner of General Services, at such salary and for such term as may from time to time be fixed by the Town Board, and who shall perform such duties as may be directed by the Town Board and as are vested in and imposed upon that office by the provisions of this article or any other statute or law. The Commissioner of General Services shall have full power and authority, to appoint or remove employees within the Department in accordance with the Civil Service Law and other applicable laws, except the appointment and removal of the Deputy Commissioner of General Services, who shall be appointed and removed by the Town Board. The Commissioner of General Services shall have powers as shall be necessary for the proper administration of the Department, consistent with applicable provisions of law, and shall have sole discretion and judgment to amend or modify the allocation of responsibilities or to establish, consolidate or abolish divisions or bureaus within the Department. The Commissioner or his/her Deputy may also serve as a division head within the Department. In the absence of the Commissioner, the Deputy Commissioner shall act generally for and in place of the Commissioner.

A. 
The Commissioner shall have such powers as shall be necessary for the proper administration of the Department consistent with applicable provisions of law.
B. 
Until such time as the same may be either amended or modified, the Department shall be divided into the following Divisions:

(1) 
Division of Abandoned Vehicles.
(2) 
Division of Fleet Maintenance.
(3) 
Division of Central Reproduction and Mailing and Central Receiving.
(4) 
Division of Senior Citizen Services.
(5) 
Division of Space Management.
(6) 
Division of Veterans' Services.
(7) 
Division of Women's Services.
(8) 
Division of Youth Bureau.

The powers and duties of such divisions herein shall be under the administration, direction and control of the Commissioner, and each of said divisions shall be supervised by an individual designated by the Commissioner. The Commissioner may, with the approval of the Town Board after a public hearing, establish, consolidate or abolish any divisions in said Department. In addition, (s)he may establish, consolidate or abolish any bureau or subdivision now existing or hereafter created in any such division. The provisions of any local law to the contrary notwithstanding, the functions, powers and duties of such divisions shall be as follows:
A. 
Division of Abandoned Vehicles. The Division shall administer the removal of all abandoned vehicles in the Town in conformance with and pursuant to all applicable laws, as well as also assisting the Suffolk County Police Department with road hazards, 511, ATV impounds and removing abandoned vehicles and boats from the community.
B. 
Division of central reproduction and mailing and central receiving. This Division is responsible for the oversight of the Town mail room, collection and distribution of all incoming and outgoing mail, including packages at all Town of Brookhaven facilities, and the reproduction of printed materials and forms used by various departments of the Town of Brookhaven.
C. 
Division of Fleet Maintenance. The Division will have the responsibility for servicing and maintenance of all Town motor vehicles, in addition to maintaining all boats and trailers. The Division is responsible for writing specifications and ordering new vehicles each year according to the Town's Vehicle Policy. Motor vehicles maintained by the Highway Department, special equipment for the Department of Waste Management and special equipment for the Department of Parks, Recreation and Cultural Services shall be exempt from this section, and said vehicles or special equipment shall be serviced and maintained by the respective departments.
D. 
Division of Senior Citizen Services. The Division of Senior Citizen Services shall serve to promote and enrich the quality of life for our senior citizens. This Division oversees the administration of the Residential Repair Program, Helpline Telephone Reassurance Program For The Homebound, Nutrition Program, Jitney Program, as well as other senior citizen programs. Additionally, this Division shall work with local communities to improve coordination of Town-wide transportation options to better serve people with disabilities, senior citizens and low-income individuals.
(1) 
Division of Senior Citizen Services of the Town of Brookhaven shall be comprised of a Senior Citizen Advisory Committee (hereinafter referred to as the "Advisory Committee").
(2) 
Senior Citizen Advisory Committee.
(a) 
Composition. The Advisory Committee shall be comprised of 15 senior citizen members chosen by the Town Board. Each Council District shall appoint two members, and the Supervisor shall appoint the remaining three members. The members of the Advisory Committee shall serve without compensation. Senior citizens shall comprise 100% of the total membership of the Advisory Committee. For the purpose of this section, the term "senior citizen" shall mean any resident of the Town of Brookhaven over the age of 55.
(b) 
Powers and duties. The Advisory Committee shall be an advisory body and shall serve at the direction of the Town Board, providing advice and recommendations on programs for the senior citizens of the Town of Brookhaven, the formulation and adoption of rules and bylaws governing the activities of the Advisory Committee and the recommendation of educational programs related to the problems of seniors and the correction thereof.
(c) 
Term of appointment.

Appointments made following the adoption of this section shall be for two years. All appointments shall be effective at the organizational meeting of the Town Board.
(d) 
Removal of Advisory Commission members.

Members of the Advisory Commission may be removed for cause by the Town Board.
E. 
Division of Space Management. The powers and duties include the space allocation and utilization of all Town-owned buildings and those leased for use by the Town.
F. 
Division of Veterans' Services. This Division, in the context of human services, addresses the needs and concerns of veterans by disseminating information regarding programs and services to benefit and assist local veterans.
G. 
Division of Women's Services. This Division is responsible for and dedicated to the needs and concerns of women. It shall oversee the administration of all Town programs that provide services for women.
(1) 
Division of Women's Services of the Town of Brookhaven shall be comprised of a Women's Services Advisory Committee (hereinafter referred to as the "Advisory Committee").
(2) 
Women's Services Advisory Committee.
(a) 
Composition. The Advisory Committee shall be comprised of 15 members chosen by the Town Board. Each Council District shall appoint two members, and the Supervisor shall appoint the remaining three members. The members of the Advisory Committee shall serve without compensation.
(b) 
Powers and duties. The Advisory Committee shall be an advisory body and shall serve at the direction of the Town Board, providing advice and recommendations on programs for the women of the Town of Brookhaven, the formulation and adoption of rules and bylaws governing the activities of the Advisory Committee and the recommendation of educational programs related to women.
(c) 
Term of appointment.

Appointments made following the adoption of this section shall be for two years. All appointments shall be effective at the organizational meeting of the Town Board.
(d) 
Removal of Advisory Commission members.

Members of the Advisory Commission may be removed for cause by the Town Board.
H. 
Division of Youth Bureau. The Division of Youth Bureau shall provide for the many needs of youth in the Town of Brookhaven and shall serve to promote the moral, physical, mental and social well-being of youth in the Town of Brookhaven in order to prevent delinquency and youth crime by fostering services aimed at strengthening family life and enabling all youth to attain their fullest individual potential.
(1) 
The Division of Youth Bureau of the Town of Brookhaven shall be minimally comprised of the Youth Committee (hereinafter referred to as the "Board").
(2) 
Youth Committee.
(a) 
Composition. The Committee shall be comprised of from 13 to 28 members at the discretion of the Town Board. The members of the Committee shall be appointed by the Town Board and serve without compensation. Lay citizens shall comprise at least 50% of the total membership of the Board and shall be representative of such related interests as social agencies, business, youth organizations, religious organizations, industry and labor. Public officials may comprise the remainder of the Committee's membership and shall include representatives of disciplines directly concerned with the welfare of the youth.
(b) 
Powers and duties. The Committee shall be and shall serve at the direction of the Town Board and shall be responsible for the following programs and functions:

The recommendation of policies and programs for the prevention and control of delinquency and crime by youth.
[2] 
The review and analysis of plans for the creation or expansion of youth programs.
[3] 
The recommendation of qualified personnel to be employed by the Youth Bureau in effectuating any of its youth programs.
[4] 
The performance of such other duties relative to the effective implementation of the intent of this article as may from time to time be requested by the Town Board.
(c) 
Terms of appointment.

Appointments made following the adoption of this section shall be for two years. All appointments shall be effective at the organization meeting of the Town Board.
(d) 
Removal of Youth Board members.
[1] 
Members of the Youth Board may be removed for cause by the Town Board.
Nothing herein contained shall be construed to delegate or transfer any power of the Town Supervisor as outlined in the Town Law of the State of New York or any statutory or other powers which may be lawfully executed by said Supervisor.
If any section, provision or part thereof in this article shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of the article as a whole or any section, provision or part hereof not adjudged invalid or unconstitutional.
