It is the intent of the Town Board of the Town of Brookhaven to limit
the number of dumps and the quantity of garbage to that necessary to dispose
of the refuse and garbage collected within the confines of the Town of Brookhaven
and to prevent other municipalities outside the Town of Brookhaven from establishing
dumps within our Town for the dumping of their garbage. Therefore, it is the
intent of this chapter to prohibit the establishment of dumps by other municipalities
or by private persons within the Town of Brookhaven.
A.
No municipality or private person other than the Town of Brookhaven shall establish or maintain a garbage dump, disposal area or sanitary landfill operation for the disposition and deposition of litter, as defined by § 45-2 of the Code of the Town of Brookhaven.
B.
The term "person" shall mean and include a corporation,
partnership or other legal entity.
