[HISTORY: Adopted by the Town Board of the Town of Brookhaven 6-16-1987 by L.L. No. 7-1987. Amendments noted where applicable.]
No local law shall be adopted by the Town Board of the Town of Brookhaven until a public hearing has been held thereon not less than 10 days after public notice has been given of the time and place of the public hearing. Such notice shall be given by the Town Clerk by causing the same to be published once in an official newspaper circulating in the Town of Brookhaven. Such notice shall contain the title and a brief explanation of the local law.
The Town Clerk shall forthwith, upon the adoption of the local law by the Town Board, post a copy thereof on the signboard maintained by him and shall, within 10 days after such adoption, cause the local law or an abstract thereof describing the same in general terms to be published once in an official newspaper circulating in the Town of Brookhaven.
Proof of publication of the notice of public hearing required by § 49A-1 hereof and proof of posting and publication required by § 49A-2 hereof shall be filed in the office of the Town Clerk.
Each local law shall be numbered consecutively beginning with the number one for each calendar year. When a local law is finally adopted and certified copies thereof are required by § 27 of the Municipal Home Rule Law to be filed in the offices of the Town Clerk, the State Comptroller and the Secretary of State, the Town Clerk shall accordingly assign to such local law the appropriate number.
No consent to the incorporation of a sewage disposal corporation, pursuant to § 116 of the Transportation Corporations Law, shall be given by the Town Board of the Town of Brookhaven until a public hearing has been held thereon as heretofore provided in § 49A-1.
No rates shall be agreed upon by and between the Town Board of the Town of Brookhaven and a sewage disposal corporation, pursuant to § 121 of the Transportation Corporations Law, until the public hearing has been held thereon as heretofore provided in § 49A-1.
