No person, persons, firm or corporation shall operate a temporary food establishment within the limits of the City of Passaic or permit the operation of any of the same on his premises or property unless and until the following licenses therefor are first obtained from the Division of Health of the City of Passaic:
A. 
Blanket temporary food establishment license. The person, persons, firm or corporation responsible for organizing and running a special event involving the serving of food to the public, whether with or without charge, including carnivals, circuses, picnics, fairs and similar events, shall apply and obtain a blanket temporary food establishment license.[1]

B. 
Temporary food establishment license. A temporary food establishment license shall be required for each individual stand, kiosk, booth, table, or similar conveyance at the special event from which food will be served to the public. It shall be the duty of the blanket temporary food license applicant to apply for and obtain all temporary food establishment licenses necessary for the event. The blanket temporary food establishment licensee shall ensure that only licensed temporary food establishments operate at this event.
The person, persons, firm or corporation responsible for organizing and running a special event involving the serving of food to the public shall apply, in writing, on forms promulgated and supplied by the Division of Health. Such forms shall be duly verified by the applicant. The applicant shall set forth:
A. 
The name, permanent addresses and telephone number of the person, persons, firm or corporation who shall serve as the blanket temporary food establishment licensee and who shall be responsible for organizing and running a special event involving the serving of food to the public.
B. 
If the applicant is a corporation, partnership, LLP or LLC, provide the name and address of its registered agent.
C. 
The full name, location, date(s), and rain date(s) for the special event.
D. 
A list for all temporary food establishments which will be operating at the event, and the name, permanent address and telephone number for the person, persons, firm or corporation who will be operating each temporary food establishment, along with a list of foods which will be prepared and served at the establishment.
E. 
If fixed toilet facilities will be used, the applicant shall provide a description of the type, number, and location for such toilet facilities.
F. 
If portable toilets will be used, the applicant shall provide a description of the type of portable toilet facilities to be used, contact information on the business from which the portable toilets will be obtained, the proposed location for such toilets at the event, and the number of toilet facilities which will be provided for public use.
Upon receipt of an application for a special event in which food will be served to the public, the Division of Health shall conduct an investigation into the plans for preparation and serving of the food, including qualifications of food handlers and the type of equipment to be used. Upon preliminary satisfactory evidence of compliance with this article and N.J.A.C. 8:24-1.1 et seq., the Division of Health shall issue a blanket temporary food license and all necessary temporary food establishment licenses. All applications for special event blanket temporary food licenses and temporary food establishment licenses must be completed and submitted to the Division of Health at least 10 calendar days before the event.
A. 
The following license fees shall be made payable to the City of Passaic Division of Health:
(1) 
Blanket food establishment license: $150.
(2) 
Temporary food establishment license: $100.
(3) 
Duplicate blanket or temporary license fee: $25.
B. 
No license fees, late fees, or duplicate fees shall be charged to public schools or charitable or nonprofit organizations.
C. 
Fees for licenses issued under this article shall only be made payable to the Division of Health by the applicant in cash, cashier's check, or money order.
Licenses, once issued by the Division of Health, shall not be transferable to another event, location, person or entity, or date.
The temporary food establishment license, along with the inspection evaluation placard, shall be posted in a conspicuous place where it may be readily observed at eye level by all patrons on the stand, kiosk, booth, table, or other similar conveyance during the length of the establishment's operation. No portion of the license or evaluation placard shall be obstructed from view during display. It shall be unlawful for the any person to erase, cancel, deface, or alter any license or evaluation placard once it has been issued by the Division of Health.
Temporary food establishments shall meet the following requirements at all times when in operation:
A. 
An approved means of hand-washing, such as commercially packaged hand-wash tissues or an approved hand-washing facility, shall be provided for convenient and expeditious use of all food handlers.
B. 
No home-prepared, potentially hazardous foods shall be used, sold, or served at a temporary food establishment. All foods served shall be commercially prepackaged or prepared either at the temporary food establishment or a licensed food establishment approved by the Division of Health.
C. 
All foods used, prepared, sold, or served shall be wholesome.
D. 
All potentially hazardous food shall be maintained at or below a temperature of 41° F. or at or above a temperature of 135° F. during transport to the event, storage, and display. Ice, portable refrigeration units, steam tables, or approved burners shall be used to maintain proper temperatures.
E. 
Temperature measuring devices shall be used and monitored by food-handling personnel to ensure maintenance of required temperatures.
F. 
Foods stored in steam tables or burners shall be stored in shallow pans having depths no greater than four inches.
G. 
All foods shall be elevated off of the ground a minimum of six inches and shall be protected from contamination and vermin at all times.
H. 
The premises in which temporary food establishments operate shall be kept clean, free of litter, free of nuisances, and sanitary at all times. Ample waste receptacles to permit collection of refuse and litter shall be provided. Waste receptacles shall be routinely serviced to prevent overflow.
A. 
Portable toilets of sufficient quantity shall be provided for special events with temporary food establishments, unless the applicant for the blanket license can substantiate the sufficient availability of fixed toilet facilities in the immediate area of the event site and that such fixed toilet facilities will be available to the public during the entire length of time the event operates.
B. 
The location for placement of portable toilets shall be subject to the approval of the Division of Health.
C. 
Portable toilets shall be so located and constructed so as to prevent leakage or seepage of contents onto the ground or contamination of ground and surface water.
D. 
Portable toilets shall be properly ventilated, vermin-proof, and maintained in a sanitary manner and shall be serviced as often as necessary so as to prevent overflow of contents.
E. 
Portable toilets shall have self-closing doors which may be locked from the inside by patrons.
F. 
An ample supply of toilet paper shall be provided in each portable toilet during the duration of the event.
G. 
Portable toilets shall not remain on the premises longer than one day after the event has ended.
