[Adopted 6-19-1975 by Ord. No. 297-75 as Section 3-8 of Chapter III of the Revised General Ordinances of the City of Passaic, 1975]
As used in this article, the following terms shall have the meanings indicated:
PARK
All public parks, playground facilities and other facilities used for recreation.

The hours during which the parks shall be open to the public shall be from the hours of 6:00 a.m. to sunset. During the months of May through September, the parks shall remain open to the public until 10:00 p.m.
The following rules and regulations shall apply to all parks within the city:
A. 
No person shall remove, deface or damage any benches, tables, trees, shrubs, soil, plants, playground or other park equipment.
B. 
At no time will the sale or consumption of alcoholic beverages be permitted; the only exception shall be those circumstances where the Alcoholic Beverage Control Board and the Passaic City Council shall mutually agree that a special event warrants waiver of this subsection.

C. 
No person shall throw, discharge or otherwise place or cause to be placed or deposit or leave any paper, bottles, broken glass, boxes, cans, dirt, rubbish, trash, waste, garbage or refuse of any kind in any place other than in proper receptacles provided for the receipt thereof.
D. 
No person shall permit any animal to remain or run at large in the parks.
E. 
No person shall hunt, molest, injure, capture or in any way interfere with any bird, squirrel or other animal being the property of the city in any park.
F. 
No person shall enter or park a vehicle upon any portion of lawn or other cultivated ground in any city park within the city when forbidden to do so by an official sign or other official notification.

G. 
No person shall remain in or enter the parks between the hours of sunset and 6:00 a.m.

H. 
Any group consisting of more than 10 people utilizing the facilities of any park in the City of Passaic as a picnic area is prohibited unless sanctioned by the Division of Recreation or the Passaic City Council.

I. 
Any group playing an organized activity on any field in any park in the city must obtain a field permit from the Division of Recreation. Organized activities on any field without a use permit from the Division of Recreation is prohibited.

A. 
No person shall fish in Hughes Lake or waters flowing in Third Ward Park without a permit from the Director of Parks and Public Property. Any person fishing without a permit or fishing in violation of any regulations provided by this section shall be declared to be a trespasser.
B. 
A permit shall be issued only to residents of the city. Fees for such permits shall be as follows.
(1) 
Children under 16 years of age: no fee.
(2) 
All other persons: $3 per day.
C. 
Each person fishing shall have in his or her possession a valid and subsisting permit issued by the Director of Parks and Public Property.
D. 
The permit number shall be displayed on outer clothing.
E. 
Fishing is prohibited except between 8:00 a.m. and sunset.
F. 
All fishing, except by hook and line, is specifically prohibited.
G. 
All persons shall comply with such additional rules and regulations as the Director of Parks and Public Property may, from time to time, promulgate in the interests of the city. Such rules and regulations shall become effective when posted on or in the shelter house, located lakeside in Third Ward Park.
A. 
No vehicle used for commercial purposes shall use any of the roads, streets or driveways running through or within any of the public parks of the city. The director of the Department of Parks and Public Property shall place proper signs designating such limitations.
B. 
The speed limit for all vehicles using the driveways in the parks shall not exceed 20 miles per hour.
C. 
No person shall use the parks for the purpose of giving instruction in the driving of cars.
D. 
Parking of cars on the driveways or lawns is prohibited except at such places as are designated by signs as parking areas. No person shall park a car between the hours of sunset and 6:00 a.m. unless the person is participating in or attending an official function or affair taking place in the park which is sanctioned by the Division of Recreation or the Passaic City Council.

E. 
The parking lot adjacent to the dog pound is excluded from parking regulations in effect in the parks. Overnight parking is permitted for cars as designated by signs.

A. 
The tennis courts shall fall under the direct supervision and jurisdiction of the Division of Recreation.
B. 
An identification card shall be available from the Division of Recreation at a cost of $3 for adult residents and $1 for residents under 18 years of age. The possessor of said card shall be entitled to use of all tennis courts, by permit, at no fee, during daylight hours, beginning at 7:00 a.m.
