Every owner of property in the City on any street that is paved, curbed and flagged shall remove the snow and ice from the sidewalk abutting or bordering such property within 24 hours after snow shall fall or ice shall form thereon and shall remove all grass, weeds and other impediments therefrom within three days after notice to remove the same.
If snow and ice, grass, weeds or other impediments are not removed from any sidewalk or gutter so as to make a safe passageway at least 28 inches wide in residential areas or the entire width of the sidewalk or flag in business districts within the time required in § 255-1, it shall be removed by the Department of Public Safety and the cost, as nearly as can be ascertained, shall be a lien upon the premises and shall be added to, recorded and collected in the same manner as taxes next to be assessed and levied upon such premises. The imposition and collection of the fine or fines imposed by the provisions of this subsection shall not constitute any bar to the right of the City to collect the costs as certified for the removal of the snow or ice.

A. 
No person, including the owner or occupant of any lands or premises abutting or bordering upon any street, shall place, deposit, throw or shovel any snow or ice into or upon that portion of any such street which has been cleaned, plowed or shoveled of snow or ice by the City or by any governmental agency or authority or by any public utility having and exercising a franchise or permit to operate autobuses along any streets in the City at any time after said street has been cleaned or plowed as aforesaid.
B. 
No owner or occupant of any lands or premises abutting or bordering upon any street shall cause, allow or permit any person to do or perform any of said conduct prohibited by Subsection A of this section.

A. 
For any violation of §§ 255-1 and/or 255-2, no court appearance is necessary if the person corrects the condition cited immediately upon the receipt of a summons and pays the fine before the date of the first court appearance.

B. 
Any residential property owner who violates §§ 255-1 and/or 255-3 shall be fined $100 for each offense. Any commercial property owner who violates §§ 255-1 and/or 255-3 shall be fined $200 for each offense.

C. 
The imposition and collection of the penalty or penalties imposed by Subsection A of this section shall not bar the right of the city to collect the costs of removal as provided in § 255-2 hereof.

The provisions of this chapter shall be enforced by the Housing Inspectors of the City of Passaic and the Passaic Police Department.
