As used in this article, the following terms
shall have the meanings indicated:
A person or entity whose business involves construction and
removal of construction debris, such as roofing shingles, wood and
asphalt.
No contractor shall perform any construction
function within the Borough of Upper Saddle River without obtaining
a permit from the Building Department. All construction work by an
unlicensed contractor is hereby prohibited. No property owner or occupant
shall permit any unlicensed contractor to perform any construction
function on his or her property. The permit shall be obtained by the
proprietor of the construction business or by a corporate officer.
A.
The applicant for a license to operate or conduct
business as a construction contractor in Upper Saddle River shall
make application on forms prescribed by the Borough Clerk. The applicant
will apply at the Building Department.
B.
A license will be issued for a period of one calendar
year from January 1 to December 31.
C.
There will be no charge for first-time applicants,
and no renewal fees will be charged if recycling tonnage receipts
from previous construction projects have been submitted.
Tonnage receipts must be submitted at the conclusion
of each construction project or at the time the contractor applies
for a certificate of occupancy or a certificate of approval from the
Building Inspector.
A.
All construction debris removed from a property must be recycled at a licensed transfer station and the tonnage receipts for tipping given to the Recycling Coordinator in accordance with § 76-69.
B.
The license issued pursuant to this article or a photocopy
signed by the licensee shall be in the actual possession, together
with the vehicle registration and identification papers, of the person
performing work at the site.
C.
The name of the construction company shall be clearly
indicated on both sides of the vehicle used in said operation, shall
be no less than three inches in height and shall include name, address
and telephone number.
D.
No one shall deposit any construction debris onto
public highways or right-of-way or onto adjoining properties.
E.
Every applicant for a license shall review the applicable
laws, ordinances, rules and regulations and shall so state that the
applicant and all of its employees are familiar with such prior to
the issuance of any license.
F.
The Mayor and Council may promulgate, by resolution,
such additional rules and regulations as it deems necessary to further
the purpose of this article.
All licenses issued pursuant to this article
shall expire on the last day of December in the year in which they
have been issued. Permits may be renewed by February 1 at no charge
if the submittal of recycling tonnage receipts from previous projects
has been made. If tonnage receipts are not submitted, renewals made
from February 2 to March 1 will be charged $100; renewals made from
March 2 to April 1 will be charged $200; renewals made after April
1 will be charged $300.
