GENERAL REFERENCES
Retail food establishments — See Ch. 179.
As used in this chapter, the following terms shall have the meanings
indicated:
Any fixed or mobile restaurant in which food or drink is prepared
or processed for human consumption, be it for on- or off-premises consumption.
Any person charged with the responsibility of overseeing the operations,
including the supervision of employees engaged in the preparing or processing
of food or drink intended for human consumption, be it for on- or off-premises
consumption.
A.
All retail food establishments are required to have,
on the premises, at all such times the establishment is in operation or open
for business, a supervisor who possesses a valid food handler's certificate.
Establishments shall provide personnel to an approved food handler training
course in the following manner:
(1)
Take-out and miscellaneous establishment: one person
per shift.
(2)
Restaurants of 49 seats and below: one person per shift.
(3)
Restaurants of 50 seats and above: two persons per shift.
(4)
Supermarkets: one store manager and one person from each
department per shift.
(5)
Schools: one person per shift.
(6)
Short- and long-term-care facilities: one person per
shift.
B.
A food handler's certificate, renewable every two
years, shall be issued to any person successfully completing a course of instruction
given or approved by the Borough of Upper Saddle River's Health Officer.
All courses shall be in compliance with current New Jersey State Department
of Health guidelines for food course training. The cost of the course is $30
and shall be borne by the applicant.
No person to whom a food handler's certificate is issued shall
give, loan, transfer or permit the same to be used by any other person for
any purpose whatsoever.
Any establishment not in compliance with any provision of this chapter
shall be subject to fines/costs not to exceed $1,000. The Board of Health
may suspend the retail food establishment license of any person, partnership,
corporation or establishment in violation of this chapter for a period of
not more than three days, pursuant to the authority of the Board of Health
to license and regulate food establishments as provided by N.J.S.A. 26:3-31c.
