The purpose of this chapter is to regulate the use of parks of the Town of Clarkson.
The following terms shall have the meanings indicated in this section:
PARKS
The grounds, buildings thereon, waters therein and any other property necessary for the operation thereof and constituting a part thereof, which are now or hereafter will be maintained, operated and controlled by the Town of Clarkson for public park purposes.
PERSON
Any individual, firm, partnership, corporation or association of persons; the singular number shall include the plural.
TOWN
The Town of Clarkson.
The following activities are prohibited:
A. 
Parking a motor vehicle in other than designated locations.
B. 
Operating a motor vehicle in any manner contrary to posted regulations.
C. 
Operating any motorized vehicles such as automobiles, minibikes, motorcycles, snowmobiles and the like within the area of the parklands; provided, however, that the operation of licensed vehicles for the transportation of the public to and from the parklands is permitted within designated roadways, and the parking of such vehicles is also permitted within designated parking areas.
D. 
Allowing dogs to run unleashed.
E. 
Sports in locations other than those designated by the Town Board.
F. 
Entering or using the parks during other than the designated hours posted by the Town Board.
G. 
Overnight parking of motor vehicles.
H. 
Sale of alcoholic beverages, as defined in the Alcoholic Beverage Control Law, in any town park.
I. 
The use of any alcoholic beverage other than beer and wine in any town park.
J. 
The use of beer and wine other than in the picnic and pavilion areas of the park.
K. 
The use of or being under the influence of any illegal drug or substance.
L. 
Possess or use firearms, bow and arrow or other dangerous weapons within the park, unless authorized by law or the Town Board of the Town of Clarkson.
M. 
Disturb the peace and good order in the parks by fighting or arguing in loud voices or threaten violence to any person or the property of others.
N. 
Beg, hawk, peddle or solicit within the parks except as authorized by the Town Board.
O. 
Use profane or abusive language while in the parks.
P. 
Injure, deface, destroy, disturb or remove any part of the parks.
Q. 
Loiter in or near park restroom buildings.
R. 
Litter or leave behind refuse, trash and garbage. The park is a carry in/carry out park. All refuse, trash and garbage brought in or generated by a function or activity in the park should be removed by the user.
S. 
Start a fire in a park except in park grills, fireplaces or designated areas.
T. 
Fail to extinguish before leaving the park all fires started or used. The dumping of ashes or fire onto the ground is absolutely prohibited.
U. 
Golf practice or any golfing activities.
V. 
Bathing, wading or swimming.
W. 
Riding or having horses in the park except in areas specifically designated for horses.
A. 
Reservations are required for use of parks as follows:
(1) 
Athletic fields: All organized groups are required to have reservations. When not reserved they are open to the public on a first come, first served basis for individuals and for other than organized groups.
(2) 
Horse ring: organized groups of any size require a reservation. When not reserved it is open to the public on a first come, first served basis for individual, noncompetitive use.
(3) 
Lodge: also subject to payment of fee and deposit as set forth below.
B. 
No park or portion thereof will be reserved for any group whose size or activity, in the opinion of the Town Board, will be detrimental to the park.
C. 
Reservations will be issued by the Town Clerk.
D. 
Use of the lodge requires a permit and payment of a fee and a deposit for damages and cleanup. The fee and damage deposit will be in accordance with a fee schedule adopted by the Town Board and amended from time to time, a copy of which is on file in the Town Clerk's office. The purpose of the deposit is to guarantee that the area has been properly cleaned up after such event and no damage has been caused thereto by the applicant. The deposit shall be refunded to the applicant after determination of damage and cleanup by the Highway Superintendent or his designee.
A. 
No person shall be permitted to remain, stop or park within the confines of any town park between the hours of 10:00 p.m. and 6:00 a.m. prevailing local time except in emergencies or with special permit from the Town Board. In case of an emergency or when, in the judgment of the Town Board, the public interest demands it, any portion of the park may be closed to the public or to designated persons until permission is given to reopen.
B. 
Notwithstanding the hours of closing stated herein, the Town Board may establish different closing hours for designated park facilities and events.
A. 
A violation of this chapter shall constitute an offense punishable by a fine and/or imprisonment, as follows.
(1) 
First offense: a fine of not less than $50 nor more than $250 and/or imprisonment not to exceed 15 days.
(2) 
Second offense: a fine of not less than $250 nor more than $500 and/or imprisonment not to exceed 15 days.
(3) 
Third or subsequent offense: a fine of not less than $500 nor more than $750 and/or imprisonment not to exceed 15 days.
B. 
Restitution; reparation; services to the town. Any person convicted of a violation of this chapter shall be subject to the provisions of § 65.10 of the New York State Penal Law and § 758-a of the New York State Family Court Act relative to the making of restitution, reparation for loss or damages and the performing of services for a public agency or the public good, which in such case shall include appropriate services working in or around the parks for the Town of Clarkson.
C. 
Parents or legal guardians of infants over 10 and less than 18 years of age shall be liable for damages or destruction caused in town parks by such infants, up to the sum of $1,000.
D. 
Any state police officer or police officer of Monroe County or any of its municipal subdivisions may, without a warrant, arrest any offender whom he may detect in the violation of any of the provisions of the above sections and take the person so arrested forthwith before a court having competent jurisdiction, and shall have at all times a right to enter the premises of any building, structure or enclosure in any park, including such grounds, buildings, structures, or enclosures in any town park which may be leased or set aside for private or exclusive use of any individual or group of individuals, for the purpose of arresting violators hereof, and may use all necessary means to attain that end.
