The Village Planning Commission of the Village of Elmsford is hereby created, which Commission shall consist of seven members, five of which are the existing Planning Board, to hold office until their present terms expire. Their successors shall be appointed for terms of three years. The two new members shall be appointed for terms of one year, and their successors shall be appointed for terms of three years. All appointments to fill vacancies shall be for the unexpired term, and all appointments shall be made by the Mayor.
Said Commissioners shall receive no compensation for their services as such Commissioners.
The time within which such Village Planning Commission shall report upon any matter or class of matters referred to it in accordance with the provisions of the General Municipal Law shall be 30 days, and, in default of such report within such period, the Planning Commission shall forfeit the right further to suspend action with regard to the particular matter upon which it has so defaulted. This section, however, shall not be construed to prevent the Board of Trustees from granting, in any specific case, such longer period as it may deem proper within which said Commission may make its report.
No plan, plot or description showing the layout of any highway or street upon private property or of building lots in connection with or in relation to such highway or street within the limits of the Village of Elmsford shall be received for record in the office of the Clerk of the County of Westchester, Division of Land Records, until a copy of said plan, plot or description has been filed with said Commission and it has certified, with relation thereto, its approval thereof.
Whenever a copy of such plan, plot or description is filed with said Village Planning Commission as provided in § 56-4 of this chapter, said Commission shall, within 30 days, report to the Board of Trustees its recommendations in relation thereto, and the Board of Trustees shall then consider the same and direct the Village Planning Commission either to certify its approval thereof or to refuse to approve of the same, and said Commission shall act at once in accordance with such directions of the Board of Trustees.
