A. 
Throughout this Part 1, the following terms shall have the meanings indicated:
ALTERATION
Any construction or renovation to an existing structure other than repair or addition.
APPROVED
Approved by the Inspector.
BOARDINGHOUSE
A building arranged or used for lodging for compensation, with or without meals, and not occupied as a single-family unit.
BUILDING
Any structure used or intended for supporting or sheltering any use or occupancy.
CURB LEVEL
The mean level of the curb along that street frontage of the building where the average curb level is highest.
DWELLING UNIT
A single unit providing complete, independent living facilities for one or more persons, including permanent provisions for living, sleeping, eating, cooking and sanitation.
EXISTING STRUCTURE
A structure erected prior to the date of adoption of the appropriate code, or one for which a legal building permit has been issued.
HEIGHT OF A BUILDING
The vertical distance from grade plane to the average height of the highest roof surface. For zoning compliance the height measurements shall be made in the manner prescribed in Chapter 335, Zoning.
HOUSEKEEPING UNIT
A room or group of rooms forming a single habitable space equipped and intended to be used for living, sleeping, cooking and eating which does not contain, within such a unit, a toilet, lavatory and bathtub or shower.
INSPECTOR
The Building Inspector, Assistant Building Inspector, or other designated Code Official.
LET FOR OCCUPANCY or LET
To permit, provide or offer possession or occupancy of a dwelling, dwelling unit, rooming unit, building, premises or structure by a person who is or is not the legal owner of record thereof, pursuant to a written or unwritten lease, agreement or license, or pursuant to a recorded or unrecorded agreement of contract for the sale of land.
LOCK BOX
Any device, including but not limited to a box, cabinet or vault, approved by a recognized laboratory, capable of securely storing keys controlling building access, fire alarms and fire-suppression equipment, as well as any hazardous material documentation.

OCCUPANT
Any individual living or sleeping in a building, or having possession of a space within a building.
OCCUPIED
A room or enclosed space designed for human occupancy in which individuals congregate for amusement, educational or similar purposes or in which occupants are engaged at labor, and which is equipped with means of egress and light and ventilation facilities meeting the requirements of this code.
OWNER
Any person, agent, operator, firm or corporation having a legal or equitable interest in the property; or recorded in the official records of the state, county or municipality as holding title to the property; or otherwise having control of the property, including the guardian of the estate of any such person, and the executor or administrator of the estate of such person if ordered to take possession of real property by a court.
PREMISES
A lot, plot or parcel of land including any structures thereon.
PUBLIC GARAGE
Any garage accessible to the public generally that is used exclusively for the parking or storage of private motor vehicles.
QUALIFIED ELEVATOR INSPECTOR (QEI)
An inspector certified by an accredited organization and qualified to inspect elevators, escalators and related equipment covered under the ASME A17.1 Elevator Code.

REPAIRS
The reconstruction or renewal of any part of an existing building for the purpose of its maintenance.
ROOMING HOUSE
A building arranged or occupied for lodging, with or without meals, for compensation and not occupied as a one- or two-family dwelling.
ROOMING UNIT
Any room or group of rooms forming a single habitable unit occupied or intended to be occupied for sleeping or living, but not for cooking purposes.
STORY
That portion of a building included between the upper surface of a floor and the upper surface of the floor or roof next above.
STRUCTURE
That which is built or constructed; it includes, among others, stadiums, reviewing stands, platforms, sheds, tents, fences and display signs.
TENANT
A person, corporation, partnership or group, whether or not the legal owner of record, occupying a building or portion thereof as a unit.
B. 
All other definitions and provisions of the New York State Uniform Fire Prevention and Building Code, as same may be amended from time to time, shall apply in connection with this article.
