A. 
Dumpsters or large garbage or refuse containers for use on private land shall be suitably protected on all sides by opaque fencing, screening or hedging at least to the height of the container or otherwise protected from open view and shall be kept in a clean and neat condition and the surrounding area must be free of litter.
B. 
Such dumpsters on public land shall be maintained only by direction and supervision of the Building Inspector or the Department of Public Works.
C. 
Property owners must keep constructed enclosures and partial enclosures in good repair and in a safe and structurally sound condition. Property owners must maintain the effectiveness of vegetation screens by properly caring for and replacing, as necessary, the plantings that serve as screening devices.

D. 
In the event that the private land presents a particular hardship in the ability of the owner to maintain the requisite screening, such owner may petition the Board of Trustees of the Village of Elmsford to vary the application of this chapter as to his/her property, which variance may be issued in the discretion of the Board of Trustees.

Any person who violates any provision of this chapter shall be guilty of a violation and upon the first conviction shall be subject to a fine which shall not exceed $500 for each day that the violation continues, and on any subsequent violation shall be subject to a fine which shall not exceed $1,000 for each day that the violation continues and to imprisonment not to exceed 15 days, or to both such fine and imprisonment for each violation.
