No rental housing unit shall be occupied until and unless a rental permit
for such unit has been issued and is in full force and effect.
No rental housing unit may be occupied by a new tenant until and unless
an application for a rental permit has been filed with the Code Enforcement
Officer at least seven days prior to such occupancy and the rental housing
unit has passed inspection by the Code Enforcement Officer, as evidenced by
the issuance of a rental permit.

A rental permit shall remain in effect for two years. The Code Enforcement
Officer shall conduct a biannual inspection before the end of the calendar
month in which the expiring permit was issued.
The rental housing unit must meet or exceed all applicable standards
and criteria as established by the local laws and ordinances of the Village
of Elmsford, as amended, and all applicable county, state and federal laws,
rules and regulations, including but not limited to the Uniform Fire Prevention
and Building Code of the State of New York.

The owner or lessor of a rental housing unit shall, within one month from
the date the Code Enforcement Officer mails an application form to the owner
or lessor, file an application for a rental permit, which shall include the
following information:
(1)Â
The name and address of the owner or lessor upon whom
violation notices and orders may be served.
(2)Â
A description of the property in which the rental housing
unit is located, as described in the tax assessment roll for the Village of
Elmsford, by section, sheet, block and lot/parcel with the correct street
address, which will enable the Code Enforcement Officer to locate the rental
housing unit.
(3)Â
Such other appropriate information as may be requested
by the Code Enforcement Officer, including a diagram of the rental housing
unit and a description of any security or fire alarm or protection system.
B.Â
The applicant shall pay an application fee of $50 with
the application for the rental permit.

Any person violating any of the provisions of this chapter shall, upon
conviction thereof, be subject to a fine of up to $500.
As used in this chapter, the following terms shall have the meanings
indicated:
The Code Enforcement Officer of the Village of Elmsford.
A dwelling unit intended for occupancy by one or more individuals.
