A. 
All residents as well as all owners, lessees and occupants of property within the Village of Elmsford shall separate recyclables from solid waste and place the recyclables out for collection in receptacles which are clearly marked to contain recyclables in accordance with the recycling/sanitation schedule and in accordance with this chapter.
B. 
Preparation of recyclables for collection.
(1) 
Recyclables shall not be placed for collection in disposable bags.
(2) 
Paper items are to be placed in a brown paper bag, corrugated cardboard box or loose in a newspaper recycling bin which shall be placed for collection at curbside. Newspapers may be bundled only with twine. Empty corrugated cardboard boxes shall have all excessive plastic adhesive removed and shall be flattened and tied with biodegradable cord, or put inside another cardboard box and placed for collection at curbside. Placement of paper items at curbside shall be done in such a manner as to avoid their being blown around or dispatched by wind or other natural elements.
(3) 
Commingled items are to be unbroken, empty and rinsed clean, have their lids removed and placed in one or more bins for collection at curbside. Only metal lids are to be recycled. Labels need not be removed. Commingled items and paper items shall not be placed in the same receptacles for collection. Aerosol cans must be emptied through normal use and the plastic caps detached if possible.
(4) 
Prior to the placement of any bulk metal items for collection, prior arrangements must be made with the Department of Public Works to schedule collection of such items. Bulk metal items that contain Freon must have the Freon removed and bear a certification sticker as having had the Freon removed before they can be collected, or a fee shall be charged by the Department of Public Works, as set forth in the Master Fee Schedule which may be amended from time to time by the Board of Trustees, to pay for removal of the Freon. Any appliance, box or container large enough for a child to enter and having doors which, when closed, cannot be opened from the inside and which has no other means for the admission of air adequate to sustain human life shall have its door removed before it is placed at curbside for collection.
(5) 
Organic yard waste such as grass clippings, flowers, leaves, weeds, brush, branches and twigs must be placed curbside in a biodegradable bag or an open pail. Branches shall not exceed three feet in length and six inches in diameter, and they shall be tied securely with biodegradable cord.
C. 
Collection of recyclables.
(1) 
In the residential districts, items for recycling shall be placed curbside for collection no earlier than 8:00 p.m. on the day before the day of collection, and the recycling receptacles must be removed from curbside on the same day as the collection. When not placed out for collection, such receptacles shall be maintained on the premises, out of view from any public street.
(2) 
In the business districts, items for recycling shall be placed out for collection at the outer edge of the sidewalk only on the days of collection not earlier than 6:00 an. and shall not be left out after the collection has been completed. At all other times in the business districts, it shall be impermissible to store items for recycling outside in front of the building, either on public or on private property, including, but not limited to setback areas, alcoves and vestibules. Where a building is located on a corner, any side of the building that faces a public street shall be considered the front of the building.
A. 
Any neglect, failure or refusal to comply with any provision of this article shall be deemed a violation thereof.
B. 
Anyone violating any provision of this article shall be subject to the penalties set forth as follows:

(1) 
For the first offense: $100 for each day of violation;
(2) 
For the second offense committed within one year: $250 for each day of violation; and
(3) 
For the third and subsequent offenses committed within one year of one another: $500 for each day of violation.
C. 
Each and every day that such violation continues after a notice of violation, summons or appearance ticket is served shall be considered a separate and specific violation of this article and not a continuing offense, except that no such notice of violation, summons or appearance ticket need be issued for subsequent violations of this article within one year of the issuance of such a notice of violation, summons or appearance ticket for the same premises; in which case, the enforcing officer may issue an appearance ticket.
