No person shall engage in the business of towing motor vehicles in the
Village of Elmsford unless such person shall possess a permit issued by the
Chief of Police to engage in such business.
The Chief of Police may issue a permit to engage in the business of
towing motor vehicles in the Village of Elmsford to an applicant who satisfies
the following conditions:
A. Any tow truck to be used for the towing of motor vehicles
shall be properly registered, inspected and insured as required by the New
York State Department of Motor Vehicles. The tow truck shall contain at least
the following equipment: fire extinguisher, broom and shovel. The tow truck
shall be operated and maintained in a safe condition.
B. The applicant shall have use of a fenced-in area for
storage of towed vehicles. The storage area shall be located in an area zoned
for such purposes, or there shall be a variance in effect to permit the use
and operation of such storage area. Any required special permit for the use
of the storage area to store towed motor vehicles shall be in effect. The
storage area shall be maintained in a reasonably neat and orderly manner.
C. The applicant shall provide a written fee schedule for
towing and storage of motor vehicles. The applicant shall conduct business
in accordance with such fee schedule.
D. The applicant shall produce evidence of liability insurance
of at least $1,000,000 for personal injury and property damage.
E. The applicant shall provide the name and telephone number
of an individual to contact in the event that the Chief of Police or any customer
needs to contact the applicant.
F. All drivers of any tow truck used to tow motor vehicles
in the Village of Elmsford shall be properly licensed by the New York State
Department of Motor Vehicles.
Every applicant for a permit to operate a tow truck used to tow motor
vehicles in the Village of Elmsford shall pay to the village an annual fee
of $100.
The Chief of Police may revoke a permit in the event that the holder
of such permit shall violate the provisions of this chapter or the permit.
The Chief shall furnish the holder of the permit with a written notice of
the basis for any proposed revocation and provide the holder a period of 10
days to cure such violation. If the violation is not then cured, the Chief
may revoke the permit.
Any person violating any part of this chapter or engaging in the business
of towing motor vehicles in the Village of Elmsford without a permit shall
be liable to a penalty of up to $250 for each offense.
