No water shall be taken for any purpose from a Village water main except through metered service or through a fire service line. A water service line shall service only one property. No meter connected to a water service line, other than one purchased from or authorized by the Village shall be installed within any premises in the Village.
A. 
All water meters shall be able to be read remotely by Water Department personnel from outside of and off the subject property on which they are located. All noncompliant meters existing as of the effective date of this article shall be replaced with remotely readable meters with a diameter of one inch or less at no cost to the property owner. For meters with a diameter over one inch, the Village charge a fee as set forth by resolution of the Village Board of Trustees in the Master Fee Schedule as same may be amended from time to time. If for any reason the owner and/or tenant or lessee of property does not permit the installation of a remotely readable meter, there will be an additional charge as set forth by resolution of the Village Board of Trustees in the Master Fee Schedule as same may be amended from time to time, each billing quarter to cover the cost of manually reading and billing the customer.
B. 
All water meters shall be supplied by the Water Department and shall remain the property of the Water Department.
C. 
All meters shall be a type, make and design approved by the Village Board, acting as Board of Water Commissioners. If there is a change in the demand for water, a Water-Department-owned meter shall be installed in accordance with Subsection D hereof
D. 
The Water Department is authorized to install gallon-type meters with remote reading capability on all new and existing buildings.
E. 
The charge for meters furnished by the Water Department shall be set forth by resolution of the Village Board of Trustees in the Master Fee Schedule as same may be amended from time to time and paid by the property owner.
A. 
Meters whose diameters are one inch or less shall be protected by the property owner at its own expense. The Village will maintain all such meters against normal wear and tear. However, damages to meters from neglect or any other cause not within the control of the Water Department shall be provided by the Village at the property owner's expense.
B. 
Meters whose diameters are larger than one inch may only be installed by a plumber licensed by the Westchester County and approved by the Water Department (at the property owner's cost and expense). All such meters shall be inspected and sealed by the Water Department. The Village shall provide no maintenance of such meters, which shall be maintained by the property owner at the property owner's cost and expense.
C. 
Meters installed within buildings shall be installed as nearly as possible to the point of entry of the water service line to the building served, and where adequate protection from freezing and damage will be afforded, and shall be kept unobstructed and easily accessible to Water Department employees at all times for service, inspection or repair. In circumstances where the customary location of a meter is in excess of 50 feet from the front property line of the property served, the Village may require the meter to be set in a pit or box, provided by and at the expense of the consumer, and located near the front property line of the premises. House piping shall be so settled that the meter may be set in a horizontal position as close to the point of entrance as practical, and must at all times be kept unobstructed and accessible to meter readers. There shall be provided a stop valve on both the inlet and outlet sides placed close to the meter. Provisions shall be made to prevent hot water from reaching the meter.
D. 
Meters permitted to be installed outside buildings shall be set in an underground meter pit of sufficient size to enable proper setting of the meter. The meter pit shall be located at a point within 10 feet of the building or as approved by the Village Board, acting as the Board of Water Commissioners, the lid of which shall be flush with the ground level or finished lawn grade or raised above grade to set the meter above groundwater. Meter setters shall be installed with stop valves on the inlet side and the outlet side of the meter. The meter dial shall be set approximately 12 inches below the pit cover.
E. 
All meters shall be readily accessible for inspection, removal or reinstallation at all reasonable times by authorized personnel of the Water Department. Meters shall not be concealed unless an easily removable access door or opening is provided for the Water Department to access the meter. Suitable access to the meter for each installation, removal or servicing shall be provided by the property owner at its sole cost and expense.
F. 
All meter pits must be inspected by the Water Department, Building Department and Village Plumbing Inspector and approved prior to installation of the meter. All meter pits must be maintained in such condition so as to permit the reading of and service to the meter at any time. The property owner, shall pay all costs and expenses to install a meter pit and cover.
G. 
Permanent meter installations requiring a two-inch or larger size meter shall be provided, at the consumer's expense, with a valved bypass around the meter and a valved spur pipe on the building side of the meter for test purposes. The design of such special meter settings shall be submitted to the Water Department for approval before construction by the consumer is undertaken.
H. 
No person shall tamper with any meter and no person other than an employee of the Water Department shall interfere with or remove any water meter, sealing device, or coupling from any meter installation after it has been placed in service by the Water Department.
I. 
Any meter damaged by frost, by hot water or steam backing into the meter, by any external cause, or otherwise, not due to any acts of the Water Department shall be repaired by the Water Department at the sole cost and expense of the property owner and the water service may be discontinued until such corrective action is taken to prevent a recurrence of the incident which caused the damage. The charge for such repairs shall be based on the cost of removing, repairing, testing and replacing said meter, plus a percentage for department overhead, transportation and use of tools which shall be set forth by resolution of the Village Board of Trustees in the Master Fee Schedule as same may be amended from time to time.
J. 
Water service may be discontinued to any customer or potential customer who denies ready access to a meter.
A. 
Authorized employees of the Board of Water Commissioners may enter the premises of any consumer between the hours of 8:00 a.m. and 4:00 p.m. to examine the service line and read the meter for the purpose of determining the quantity of water used and the manner of its use. In the event that such employees are not granted access after two attempts, then they may enter the said premises at any time.
B. 
Should such employee discover the existence of a violation of these regulations, he may discontinue the supply of water upon 48 hours' notice to the property owner or occupant and report such violation and the action taken by him thereon to the Board of Water Commissioners for further action.
C. 
If the Water Department is unable to read a meter in the normal course of the meter reader's route, the charge will be estimated on the basis of prior use in comparable periods, and the difference adjusted when the meter is again read.
D. 
If the meter is damaged or fails to operate, the bill will be based on the average use during prior comparable periods unless there is evidence that the use during prior comparable periods is not properly applicable.
A. 
The Water Department will test any meter to determine its accuracy upon either consumer request or demand from the Foreman of the Water Department. The Village will replace defective parts or the entire water meter for water meters with a service connection of one inch or less, at its expense, except where the meter is damaged by frost, by hot water or steam backing into the meter, by any external cause, or otherwise, not due to any acts of the Water Department. Any repair or replacement of water meters with more than a one-inch service connection will be paid for by the property owner regardless of the cause for such repair or replacement.
B. 
A water meter which ceases to register shall be subject to the provisions of § 328-28A above.
C. 
A consumer may request in writing to the Water Department Foreman to have its meter removed by an employee of the Board of Water Commissioners or representative authorized by the Water Department for testing by the Board of Water Commissioners. If the meter so tested shall be found to register not more than 103% of the amount of water actually passing through it, a charge as set forth by resolution of the Village Board of Trustees in the Master Fee Schedule as same may be amended from time to time shall be paid by the consumer for testing the meter. If, after testing, it is determined that the meter is out of order and does not register correctly, the consumer will be charged for water at the average consumption rates; as shown by the meter when in order, or according to the consumption during a previous corresponding quarter, at the discretion of the Board of Water Commissioners and the amount charged for such test shall be refunded by the Village. Meters damaged from any cause whatsoever shall be repaired by the Village at the expense of the consumer, said cost as set forth by resolution of the Village Board of Trustees in the Master Fee Schedule as same may be amended from time to time. If the repair charges are not paid within 30 days of the presentation of a bill for the same, the unpaid amount shall be added to the next quarterly water bill. Consumers, upon request, may have the meters serving their premises tested by the Water Department in their presence or that of a duly authorized representative. If the consumer should prefer to have a certified test of the meter conducted by a certified tester, the rate shown in the Master Fee Schedule as same may be amended from time to time, shall apply.
D. 
Testing intervals; testing entity.
(1) 
All water meters shall be tested in accordance with the Meter Testing Requirements Chart provided in Subsection F hereof. The test interval shall be as indicated in the following table:

The Village reserves the right, however, to require a meter test at any time, if, in the opinion of the Water Department Foreman, it appears the official meter has been tampered with, the seal broken or removed, or when there is a significant change in recorded consumption.
(3) 
For meters of one inch or less in diameter, the water meter shall be tested for accuracy by the Water Department, and if necessary, the meter shall be recalibrated or replaced at the Department's option at no cost or expense to the property owner.
(4) 
For meters larger than one inch in diameter, the meter shall be field tested for accuracy at the owner's expense, by a meter testing company acceptable to the Water Department Foreman and in the presence of a Water Department representative. In the event the meter does not register within the accuracy limits specified for said meter in the aforementioned Meter Testing Requirements Chart provided in Subsection F hereof, it shall be repaired and then retested to determine if it registers within the accuracy limits. The certified results of all meter tests shall be furnished to the Commissioner in writing on the forms provided within 10 days after the tests. If the meter cannot be repaired to the required degree of accuracy, it shall be replaced at the owner's expense in accordance with these rules and regulations.
E. 
The property owner's account for water consumed during the period when the meter ceased to register shall be calculated by taking either the average amount of water consumed, as recorded by the new meter, or the average amount of water consumed during a previous similar period, at the option of the Village Administrator.
F. 
Meter testing requirements.[1]

A. 
Any person, firm or corporation who shall fail to comply with the testing requirements provided for in § 328-28 of this article within 30 days of service, by first class mail, of a notice to provide certified meter test results shall be subject to a fine not less than $500 nor more than $1,000 for each offense. Each day's violation shall constitute a continuing offense.
B. 
Any person, firm or corporation violating any other provision of this article shall be subject to a fine for each violation thereof, not exceeding $1,000 for any offense. Each day's violation shall constitute a separate offense.
